safety margin to the MVEB (1.321 tpswd
VOC and 3.142 tpswd NOX), the
remaining safety margins are 2.244
tpswd for VOC and 1.671 tpswd for
NOX. Maine has not yet allocated the
remaining safety margin to any source
category under its maintenance plan,
and the State will need to submit a SIP
revision to amend its maintenance plan
if in the future it decides to use any of
the remaining safety margin. The 2016
MVEBs for Midcoast area are approvable
because the MVEBs for NOX and VOC,
including the allocated safety margins,
when added to all other inventory
sources, continue to maintain the total
emissions at or below the attainment
year inventory levels as required by the
transportation conformity regulations.
XI. Proposed Actions on Maine’s
Redesignation Requests, 175
Maintenance Plan SIP Revisions, and
Associated MVEBs
EPA is proposing to determine that
both the Portland, Maine and the
Midcoast, Maine, 8-hour ozone
nonattainment areas have attained the 8hour ozone NAAQS. EPA is also
proposing to approve the redesignation
of both the Portland, Maine and the
Midcoast, Maine 8-hour ozone
nonattainment areas from
nonattainment to attainment for the 8hour ozone NAAQS. EPA has evaluated
the State of Maine’s redesignation
requests and determined that they meet
the redesignation criteria set forth in
section 107(d)(3)(E) of the CAA. EPA
believes that the redesignation requests
and monitoring data demonstrate that
these two areas have attained the 8-hour
ozone standard. The final approval of
this redesignation request would change
the official designation for both the
Portland, Maine and the Midcoast,
Maine 8-hour ozone nonattainment
areas from nonattainment to attainment
for the 8-hour ozone standard.
EPA is proposing to approve the
maintenance plan SIP revision and the
2016 MVEBs submitted by Maine for
both the Portland, Maine and the
Midcoast, Maine 8-hour ozone
nonattainment areas in conjunction
with the corresponding redesignation
requests. EPA is proposing to approve
the maintenance plan for both the
Portland, Maine and the Midcoast,
Maine 8-hour ozone nonattainment
areas, because they meet the
requirements of section 175A as
described more fully above.
EPA is soliciting public comments on
the issues discussed in this document.
These comments will be considered
before taking final action.

XII. Statutory and Executive Order
Reviews
Under Executive Order 12866 (58 FR
51735, October 4, 1993), this proposed
action is not a ‘‘significant regulatory
action’’ and therefore is not subject to
review by the Office of Management and
Budget. For this reason, this action is
also not subject to Executive Order
13211, ‘‘Actions Concerning Regulations
That Significantly Affect Energy Supply,
Distribution, or Use’’ (66 FR 28355, May
22, 2001). This proposed action merely
proposes to approve state law as
meeting Federal requirements and
imposes no additional requirements
beyond those imposed by state law.
Redesignation of an area to attainment
under section 107(d)(3)(E) of the Clean
Air Act does not impose any new
requirements on small entities.
Redesignation is an action that affects
the status of a geographical area and
does not impose any new regulatory
requirements on sources. Accordingly,
the Administrator certifies that this
proposed rule will not have a significant
economic impact on a substantial
number of small entities under the
Regulatory Flexibility Act (5 U.S.C. 601
et seq.). Because this rule proposes to
approve pre-existing requirements
under state law and does not impose
any additional enforceable duty beyond
that required by state law, it does not
contain any unfunded mandate or
significantly or uniquely affect small
governments, as described in the
Unfunded Mandates Reform Act of 1995
(Pub. L. 104–4).
This proposed rule also does not have
tribal implications because it will not
have a substantial direct effect on one or
more Indian tribes, on the relationship
between the Federal Government and
Indian tribes, or on the distribution of
power and responsibilities between the
Federal Government and Indian tribes,
as specified by Executive Order 13175
(65 FR 67249, November 9, 2000). This
action also does not have Federalism
implications because it does not have
substantial direct effects on the States,
on the relationship between the national
government and the States, or on the
distribution of power and
responsibilities among the various
levels of government, as specified in
Executive Order 13132 (64 FR 43255,
August 10, 1999). This action merely
proposes to affect the status of a
geographical area, does not impose any
new requirements on sources, or allows
a state to avoid adopting or
implementing other requirements, and
does not alter the relationship or the
distribution of power and
responsibilities established in the Clean

Air Act. This proposed rule also is not
subject to Executive Order 13045
‘‘Protection of Children from
Environmental Health Risks and Safety
Risks’’ (62 FR 19885, April 23, 1997),
because it is not economically
significant.
In reviewing SIP submissions, EPA’s
role is to approve state choices,
provided that they meet the criteria of
the Clean Air Act. In this context, in the
absence of a prior existing requirement
for the State to use voluntary consensus
standards (VCS), EPA has no authority
to disapprove a SIP submission for
failure to use VCS. It would thus be
inconsistent with applicable law for
EPA, when it reviews a SIP submission,
to use VCS in place of a SIP submission
that otherwise satisfies the provisions of
the Clean Air Act. Redesignation is an
action that affects the status of a
geographical area but does not impose
any new requirements on sources. Thus,
the requirements of section 12(d) of the
National Technology Transfer and
Advancement Act of 1995 (15 U.S.C.
272 note) do not apply. This proposed
rule does not impose an information
collection burden under the provisions
of the Paperwork Reduction Act of 1995
(44 U.S.C. 3501 et seq.).

SUMMARY: Technical information or
comments are requested on the
proposed Base (1% annual chance)
Flood Elevations (BFEs) and proposed
BFEs modifications for the communities
listed below. The BFEs are the basis for
the floodplain management measures
that the community is required either to
adopt or to show evidence of being
already in effect in order to qualify or
remain qualified for participation in the
National Flood Insurance Program
(NFIP).
DATES: The comment period is ninety
(90) days following the second
publication of this proposed rule in a
newspaper of local circulation in each
community.
ADDRESSES: The proposed BFEs for each
community are available for inspection
at the office of the Chief Executive
Officer of each community. The
respective addresses are listed in the
table below.

SUPPLEMENTARY INFORMATION: FEMA
proposes to make determinations of
Flooding source(s)
BFEs and modified BFEs for each
community listed below, in accordance
with Section 110 of the Flood Disaster
Protection Act of 1973, 42 U.S.C. 4104,
and 44 CFR 67.4(a).
These proposed BFEs and modified
BFEs, together with the floodplain
management criteria required by 44 CFR
60.3, are the minimum that are required.
They should not be construed to mean
that the community must change any
existing ordinances that are more
stringent in their floodplain
management requirements. The
community may at any time enact
stricter requirements of its own, or
pursuant to policies established by other
Federal, state or regional entities. These
proposed elevations are used to meet
the floodplain management
requirements of the NFIP and are also
used to calculate the appropriate flood
insurance premium rates for new
buildings built after these elevations are
made final, and for the contents in these
buildings.
National Environmental Policy Act.
This proposed rule is categorically
excluded from the requirements of 44
CFR Part 10, Environmental
Consideration. No environmental
impact assessment has been prepared.
Regulatory Flexibility Act. As flood
elevation determinations are not within
the scope of the Regulatory Flexibility
Act, 5 U.S.C. 601–612, a regulatory
flexibility analysis is not required.
Regulatory Classification. This
proposed rule is not a significant
regulatory action under the criteria of
Section 3(f) of Executive Order 12866 of
September 30, 1993, Regulatory
Planning and Review, 58 FR 51735.
Executive Order 13132, Federalism.
This rule involves no policies that have
federalism implications under Executive
Order 13132.
Executive Order 12988, Civil Justice
Reform. This rule meets the applicable
standards of Executive Order 12988.

SUMMARY: Technical information or comments are requested on the
proposed Base (1% annual chance) Flood Elevations (BFEs) and proposed
BFEs modifications for the communities listed below. The BFEs are the
basis for the floodplain management measures that the community is
required either to adopt or to show evidence of being already in effect
in order to qualify or remain qualified for participation in the
National Flood Insurance Program (NFIP).
DATES: The comment period is ninety (90) days following the second
publication of this proposed rule in a newspaper of local circulation
in each community.

SUPPLEMENTARY INFORMATION: FEMA proposes to make determinations of BFEs
and modified BFEs for each community listed below, in accordance with
Section 110 of the Flood Disaster Protection Act of 1973, 42 U.S.C.
4104, and 44 CFR 67.4(a).
These proposed BFEs and modified BFEs, together with the floodplain
management criteria required by 44 CFR 60.3, are the minimum that are
required. They should not be construed to mean that the community must
change any existing ordinances that are more stringent in their
floodplain management requirements. The community may at any time enact
stricter requirements of its own, or pursuant to policies established
by other Federal, state or regional entities. These proposed elevations
are used to meet the floodplain management requirements of the NFIP and
are also used to calculate the appropriate flood insurance premium
rates for new buildings built after these elevations are made final,
and for the contents in these buildings.
