I. Abstract
The United States and several other
countries have increased the
effectiveness of their respective controls
over international trade in strategic
commodities by means of an Import
Certificate procedure. For the U.S.
importer, this procedure provides that,
where required by the exporting
country, the importer submits an
international import certificate to the
U.S. Government to certify that he/she
will import commodities into the
United States and will not reexport such
commodities, except in accordance with
the export control regulations of the
United States. The U.S. Government, in
turn, certifies that such representations
have been made.

In a charging letter filed on October
25, 2004, the Bureau of Industry and
Security (‘‘BIS’’) alleged that
Respondent, Mr. Mohammad AlMashan (‘‘Al-Mashan’’), committed two
violations of the Export Administration
Regulations (‘‘Regulations’’),1 issued
under the Export Administration Act of
1979, as amended (50 U.S.C. app. 2401–
2420 (2000)) (the ‘‘Act’’).2 Specifically,
the charging letter alleged that during
the period between on or about October
27, 1999 and on or about February 23,
2000, Al-Mashan engaged in conduct
prohibited by the Regulations when he
transferred an uncooled infrared
camera, an item subject to the
Regulations and controlled on the
Commerce Control List for national
security reasons, to an individual from
the United Arab Emirates in violation of
a BIS license condition. The BIS license

7, 2006)), has continued the Regulations in effect
under IEEPA.
