National Fuel Gas Supply Corporation
(National Fuel) tendered for filing as
part of its FERC Gas Tariff, Fourth
Revised Volume No. 1, the tariff sheets
listed in Appendix A to the filing, with
an effective date of April 30, 2006.
National Fuel states that the filing is
being made in compliance with the
Commission’s Order Accepting and
Suspending Tariff Sheets issued April
28, 2006 in the above-referenced
proceeding.

pursuant to Rule 207 of the
Commission’s Rules and Regulations (18
CFR 385.207) declaring that (1) USGen
is not contractually precluded from
filing a Section 5 complaint against
Tennessee Gas Pipeline Company
(Tennessee) challenging the
reasonableness of its rates and fuel
charges; and (2) Tennessee’s tariff does
not address the calculation of damages
or mitigation of damages arising from a
breach by a shipper, and state law
consequently governs the determination
of the mitigation of damages in the
event of a breach.
