EPA is printing a summary of a pesticide petition received under section 408 of the Federal Food, Drug, and Cosmetic Act (FFDCA), 21 U.S.C. 346a, proposing the establishment of regulations in 40 CFR part 180.593 for residues of famoxadone in or on grapes and hops. Additional data may be needed before EPA rules on this pesticide petition. On April 25, 2006, the Commission adopted and released a Second Report and Order and Second Further Notice of Proposed Rulemaking in FCC 06–52, WT Docket No. 05–211. This rulemaking will become effective thirty days after publication in the Federal Register. The Commission adopted this rulemaking governing whether applicants to participate in Commission auctions are eligible to receive designated entity (DE) benefits. Applicants to participate in the auction that claim to qualify as designated entities must so certify on FCC Form 175, the short-form application to participate in the auction. In order to allow time for the Commission to review and process their FCC Form 175, as well as to allow applicants time to correct and supplement FCC Form 175 as necessary, parties seeking to participate in the AWS 1 auction must file the form by May 10. Given that designated entity applicants will have filed FCC Form 175 prior to the effective date of any designated entity rule changes adopted pursuant to the Second Report and Order, the Commission will require each such applicant to amend its FCC Form 175 on or after the effective date of the rule changes with a statement declaring, under penalty of perjury, that the applicant is qualified as a designated entity pursuant to § 1.2110 of the Commission’s rules effective as of the date of the statement.
