hold interlocking positions is deemed
granted to those persons who filed, prior
to the effective date of Order No. 664,
i.e., prior to October 24, 2005,
completed informational reports to hold
interlocking positions under section
45.9 of the Commission’s regulations.

Assessment

In accordance with the National
Environmental Policy Act of 1969 and
the Federal Energy Regulatory
Commission’s regulations, 18 CFR part
380 (Order No. 486, 52 F.R. 47879), the
Office of Energy Projects has reviewed
the application for exemption from
licensing for the A.H. Smith Dam
Project. Staff prepared an environmental
assessment (EA) for the project, which
is located on the San Marcos River near
the town of Martindale, Caldwell
County, Texas. In the EA, Commission
staff analyzed the potential
environmental impacts of the project
and concluded that exempting the
project from licensing, with appropriate
environmental measures, would not
constitute a major federal action
significantly affecting the quality of the
human environment.
A copy of the EA is on file with the
Commission and is available for public
inspection. The EA may also be viewed
