Adeline R. Bennett, MD Living Trust and Pitts Grandchildren’s Trust, Civil Action No. LACV 06–0238 DDP (AJWx) was lodged with the United States District Court for the Central District of California. In this action, under Sections 106 and 107 of CERCLA, 42 U.S.C. 9606 and 9607, the United States sought injunctive relief and recovery of response costs to remedy conditions in connection with the release or threatened release of hazardous substances into the environment at the Waste Disposal, Inc. Superfund Site in Santa Fe Springs, California (hereinafter referred to as the ‘‘Site’’ or ‘‘WDI Site.’’). The defendants in this action own a portion of the WDI Site, and the purpose of the settlement is to provide to the United States the access and institutional controls or environmental restriction covenants which are required to perform the remedial action at the Site. In addition, the defendants have agreed to sell their land parcels within a two year period of time after Decree entry, and pay a portion of the sale proceeds to the United States in PO 00000 Frm 00148 Fmt 4703 Sfmt 4703 5379 reimbursements of its response costs. In return, the United States has provided covenants not to sue and contribution protection to each defendant.
