III. What is the Agency’s Authority for
Taking this Action?
Section 6(f)(1) of FIFRA provides that
a registrant of a pesticide product may
at any time request that any of its
pesticide registrations be amended to
delete one or more uses. The Act further
provides that, before acting on the
request, EPA must publish a notice of
receipt of any such request in the
Federal Register. Thereafter, the
Administrator may approve such a
request.
IV. Procedures for Withdrawal of
Request
Registrants who choose to withdraw a
request for use deletion must submit the
withdrawal in writing to John Jamula
using the instructions in Unit I.C. The
Agency will consider written
withdrawal requests postmarked no
later than December 5, 2005.
V. Provisions for Disposition of Existing
Stocks
The Agency has authorized the
registrants to sell or distribute product
under the previously approved labeling

ACTION: Notice.
AGENCY:
SUMMARY: This notice announces EPA’s
order for the cancellation, voluntarily
requested by the registrant and accepted
by the Agency, of a product containing
the pesticides phenothrin and smethoprene, pursuant to section 6(f)(1)
of the Federal Insecticide, Fungicide,
and Rodenticide Act (FIFRA), as
amended. This cancellation order
follows a July 15, 2005 (corrected
August 3, 2005) Federal Register Notice
of Receipt of a Request from the
registrant Hartz Mountain Corporation
to voluntarily cancel their product Hartz
Ref 117, a product labeled for use as a
spot-on for cats and kittens. In the July
15, 2005 Notice, EPA indicated that it
would issue an order implementing the
cancellation no earlier than October 31,
2005. EPA further indicated that the
request for cancellation was irrevocable.
The Agency did not receive any
comments on the Notice during the 30–
day comment period. Accordingly, EPA
hereby issues in this Notice a
cancellation order granting the
requested cancellation. Any
distribution, sale, or use of the product
Hartz Ref 117 is permitted only in
accordance with the terms of this order,
including any existing stocks
provisions.
DATES: The cancellation is effective
November 4, 2005.

Existing Stocks
Existing stocks are those stocks of
registered pesticide products which are
currently in the United States and
which were packaged, labeled, and
released for shipment prior to the
effective date of the cancellation action.
The cancellation order issued in this
Notice includes the following existing
stocks provisions.
Products in the United States that
have been packaged, labeled, and
released for shipment prior to the
effective date of the cancellation may be
sold or distributed by Hartz from its
facilities until December 31, 2005, and
may be sold or distributed by persons
other than Hartz until March 31, 2006.
After this date, products may not be
sold or distributed unless for the
purposes of proper disposal or export.
