D. Evaluation of the Changes to
Definitions, References, and Numbering
Several definitions were created or
amended due to the creation of the
general and registration permit
programs. In addition, several regulatory
citations were revised as well as other
administrative changes related to the
registration and general permit
programs. All of the changes, as
described in Part I, Section D, ‘‘Changes
to Definitions, References, and
Numbering’’, are consistent with
Wisconsin’s statutes and the Act.
IV. What Action Is EPA Taking Today?
EPA is proposing to approve revisions
to Wisconsin SIP rules NR 400, 406,
407, and 410 submitted by the State on
July 28, 2005. EPA also is soliciting
comment on this proposed approval.

Reviews
Executive Order 12866; Regulatory
Planning and Review
Under Executive Order 12866 (58 FR
51735, October 4, 1993), this proposed
action is not a ‘‘significant regulatory
action’’ and therefore is not subject to
review by the Office of Management and
Budget.
Executive Order 13211: Actions That
Significantly Affect Energy Supply,
Distribution, or Use
Because it is not a ‘‘significant
regulatory action’’ under Executive
Order 12866 or a ‘‘significant energy
action,’’ this action also is not subject to
Executive Order 13211, ‘‘Actions
Concerning Regulations That
Significantly Affect Energy Supply,
Distribution, or Use’’ (66 FR 28355, May
22, 2001).
Regulatory Flexibility Act
This action merely proposes to
approve state law as meeting Federal
requirements and imposes no additional
requirements beyond those imposed by
state law. Accordingly, the
Administrator certifies that this
proposed rule will not have a significant
economic impact on a substantial
number of small entities under the
Regulatory Flexibility Act (5 U.S.C. 601
et seq.).
Unfunded Mandates Reform Act
Because this action proposes to
approve pre-existing requirements
under state law and does not impose
any additional enforceable duty beyond
that required by state law, it does not
contain any unfunded mandate or

Executive Order 13175 Consultation
and Coordination With Indian Tribal

This proposed action does not have
tribal implications because it will not
have a substantial direct effect on one or
more Indian tribes, on the relationship
between the Federal Government and
Indian tribes, or on the distribution of
power and responsibilities between the
Federal Government and Indian tribes,
as specified by Executive Order 13175
(65 FR 67249, November 9, 2000).
Executive Order 13132 Federalism
This proposed action does not have
Federalism implications because it does
not have substantial direct effects on the
states, on the relationship between the
national government and the states, or
on the distribution of power and
responsibilities among the various
levels of government, as specified in
Executive Order 13132 (64 FR 43255,
August 10, 1999). This action merely
proposes to approve a state rule
implementing a federal standard, and
does not alter the relationship or the
distribution of power and
responsibilities established in the Act.
Executive Order 13045 Protection of
Children From Environmental Health
and Safety Risks
This proposed approval is not subject
to Executive Order 13045 ‘‘Protection of
Children from Environmental Health
Risks and Safety Risks’’ (62 FR 19885,
April 23, 1997), because it is not a
significant regulatory action under
executive order 12866.
National Technology Transfer
Advancement Act
Section 12(d) of the National
Technology Transfer and Advancement
Act of 1995 (NTTA), 15 U.S.C. 272,
requires federal agencies to use
technical standards that are developed
or adopted by voluntary consensus to
carry out policy objectives, so long as
such standards are not inconsistent with
applicable law or otherwise
impracticable. In reviewing program
submissions, EPA’s role is to approve
state choices, provided that they meet
the criteria of the Act. Absent a prior
existing requirement for the state to use
voluntary consensus standards, EPA has
no authority to disapprove a program
submission for failure to use such
standards, and it would thus be
inconsistent with applicable law for

standards in place of a program
submission that otherwise satisfies the
provisions of the Act. Therefore, the
requirements of section 12(d) of the

Civil Justice Reform
As required by section 3 of Executive
Order 12988 (61 FR 4729, February 7,
1996), in issuing this rule, EPA has
taken the necessary steps to eliminate
drafting errors and ambiguity, minimize
potential litigation, and provide a clear
legal standard for affected conduct.
Governmental Interference With
Constitutionally Protected Property
Rights
EPA has complied with Executive
Order 12630 (53 FR 8859, March 15,
1988) by examining the takings
implications of the rule in accordance
with the ‘‘Attorney General’s
Supplemental Guidelines for the
Evaluation of Risk and Avoidance of
Unanticipated Takings’’ issued under
the executive order, and has determined
that the rule’s requirements do not
constitute a taking.
Paperwork Reduction Act
This proposed action does not impose
an information collection burden under
the provisions of the Paperwork
Reduction Act of 1995 (44 U.S.C. 3501
et seq.).

Consideration. No environmental
impact assessment has been prepared.
Regulatory Flexibility Act. The
Mitigation Division Director of the
Emergency Preparedness and Response
Directorate certifies that this proposed
rule is exempt from the requirements of
the Regulatory Flexibility Act because
proposed or modified BFEs are required
by the Flood Disaster Protection Act of
1973, 42 U.S.C. 4104, and are required
to establish and maintain community
