occur as a result of the construction and
operation of a residential development
on 1,758-acres (717 hectares) of the

County, Texas. The Service has
prepared the Environmental
Assessment/Habitat Conservation Plan
(EA/HCP) for the incidental take

Section 9
of the Act prohibits the ‘‘taking’’ of
endangered species such as the goldencheeked warbler. However, the Service,
under limited circumstances, may issue
permits to take endangered wildlife
species incidental to, and not the
purpose of, otherwise lawful activities.
Regulations governing permits for

Applicant: White Water Springs,
L.L.C., plans to construct a residential

compensate for this incidental take of
the golden-cheeked warbler by
contributing $300,000 to a conservation
entity for use in the purchase and
preservation of golden-cheeked warbler
habitat within the acquisition area of the
Balcones Canyonlands National Wildlife

be managed in perpetuity for the benefit
of the golden-cheeked warbler.
