Regulations governing permits for endangered species are at 50 CFR 17.22. Applicant: White Water Springs, L.L.C., plans to construct a residential development on 1,758-acres of the White Water Springs property, Burnet County, Texas. This action would adversely affect 369.1 acres (148.8 hectares) of oak-juniper woodland resulting in take of the golden-cheeked warbler. The Applicant proposes to compensate for this incidental take of the golden-cheeked warbler by contributing $300,000 to a conservation entity for use in the purchase and preservation of golden-cheeked warbler habitat within the acquisition area of the Balcones Canyonlands National Wildlife Refuge and by preserving 20.7 acres (8.3 hectares) of habitat on-site which will be managed in perpetuity for the benefit of the golden-cheeked warbler.
