combined).
The MVEBs requested by IDEM
contain safety margins (selected by the
State) significantly smaller than the
safety margins reflected in the total
emissions for the Evansville area. The
State is not requesting allocation of the
entire available safety margins reflected
in the demonstration of maintenance.
Therefore, even though the State is
requesting MVEBs that exceed the onroad mobile source emissions for 2015
contained in the demonstration of
maintenance, the increase in on-road
mobile source emissions that can be
considered for transportation
conformity purposes is well within the
safety margins of the ozone maintenance
demonstration.
C. Are the MVEBs Approvable?
The VOC and NOX MVEBs for the
Evansville area are approvable because
they maintain the total emissions for
Vanderburgh and Warrick Counties at or
below the attainment year inventory
levels, as required by the transportation
conformity regulations.

Under Executive Order 12866 (58 FR
51735, October 4, 1993), this action is
not a ‘‘significant regulatory action’’ and
therefore is not subject to review by the

Because it is not a ‘‘significant
regulatory action’’ under Executive
Order 12866 or a ‘‘significant energy
action,’’ this action is also not subject to

Distribution, or Use’’ (66 FR 28355, May
22, 2001).
Regulatory Flexibility Act
This proposed action merely proposes
to approve state law as meeting Federal
requirements and imposes no additional

Administrator certifies that this
proposed rule will not have a significant
economic impact on a substantial
number of small entities under the
Regulatory Flexibility Act (5 U.S.C. 601
et seq.).

Because this rule proposes to approve

Advancement Act
In reviewing SIP submissions, EPA’s
role is to approve state choices,
provided that they meet the criteria of
the Clean Air Act. In this context, in the
absence of a prior existing requirement
for the state to use voluntary consensus
standards (VCS), EPA has no authority
to disapprove a SIP submission for
failure to use VCS. It would thus be
inconsistent with applicable law for
EPA, when it reviews a SIP submission,
to use VCS in place of a SIP submission
that otherwise satisfies the provisions of
the Clean Air Act. Thus, the

The negative declaration certifies that
existing CISWI units, subject to Clean
Air Act (the Act) requirements of
sections 111(d) and 129 and the related
emissions guidelines (EG), have been
permanently shut down and have been
dismantled in the State of Maryland.
In the Final Rules section of this
Federal Register, EPA is approving the
MDE certification as a direct final rule
without prior proposal because the
Agency views this as a noncontroversial
action and anticipates no adverse
comments. If no adverse comments are
received in response to this action, no
further activity is contemplated. If EPA
