Needs and Uses: The MagnusonStevens Fishery Conservation and Management Act (MSA) and its regulations do not apply to scientific research activities conducted on board a scientific research vessel. Persons planning to conduct such research are encouraged to submit a research plan to ensure that the activities are considered research and not fishing. The National Marine Fisheries Service may also grant exemptions, through an application process, from fishery regulations for educational or other activities (e.g., testing of fishing gear). Those granted exemptions for any of these activities must submit annual reports. Category I and II fisheries are those identified by NOAA as have either frequent or occasional takings of marine mammals.
