As set forth in 751(c)(5)(C)(v) of the Act, the Department may treat a sunset review as extraordinarily complicated if it is a review of a transition order. The sunset reviews subject to this notice are reviews of transition orders. Therefore, the Department has determined, pursuant to section 751(c)(5)(C)(v) of the Act, that the sunset reviews of the antidumping and countervailing duty orders on brass sheet and strip from Germany, Brazil, and France are extraordinarily complicated and require additional time for the Department to complete its analysis. Therefore, the Department will extend the deadlines in these proceedings, and, as a result, intends to issue the final results of the sunset reviews of the antidumping and countervailing duty orders of brass sheet and strip from Germany, Brazil, and France, on or about October 28, 2005, 90 days from the original scheduled date of the final results of these reviews. SUPPLEMENTARY INFORMATION: Peter and Nancy Fenner (Appellant) have filed a notice of appeal with the Secretary of Commerce (Secretary) pursuant to section 307(c)(3)(A) of the Coastal Zone Management Act of 1972 (CZMA), as amended, 16 U.S.C. 1456(c)(3)(A), and implementing the regulations found at 15 CFR part 930, subpart H. The Fenners appeal an objection raised by the New York Department of State to a consistency certification contained within their application to the Army Corps of Engineers for a permit to build a catwalk and dock at West Hampton Dune. The CZMA requires a notice be published in the Federal Register, indicating the date on which the decision record has been closed. A final decision on this appeal must be issued no later than 90 days after publication on this notice. 16 U.S.C. 14659(a). The deadline may be extended by publishing, within the 90-day period, a subsequent notice explaining why a decision cannot be issued within this time frame.
