The authority citation for 14 CFR part 71 continues to read as follows: I Authority: 49 U.S.C. 106(g), 40103, 40113, 40120; E.O. 10854, 24 FR 9565, 3 CFR, 1959– 1963 Comp., p. 389. § 71.1 [Amended] 2. The incorporation by reference in 14 CFR part 71.1 of the Federal Aviation Administration Order 7400.9M, Airspace Designations and Reporting Points, dated August 30, 2004, and effective September 16, 2004, is amended as follows: I Paragraph 5000 Class D Airspace area extending upward from the surface of the earth. * * ANM CO D CO [NEW] * * * Front Range Airport, Denver, Front Range Airport, Denver, CO (Lat 39°47′07″ N., long. 104°32′35″ W.) That airspace extending upward from the surface of 8,000 feet MSL within a 5.1 nautical mile radius of the Front Range Airport, Denver, CO, excluding the Denver International Airport Class B. This Class D airspace area is effective during the specific days and times established in advance by the Notice to Airmen. ACTION: Direct final rule; request for comments. AGENCY: SUMMARY: This action amends Title 14 Code of Federal Regulations, part 71 (14 CFR 71) by revising Class E airspace areas at Mc Cook, NE. A review of the Class E airspace surface area and the Class E airspace area extending upward from 700 feet above ground level (AGL) at Mc Cook, NE reveals neither area complies with criteria in FAA Orders nor reflects the current airport name. These airspace areas and their legal descriptions are modified to conform to the criteria in FAA Orders. DATES: This direct final rule is effective 0901 UTC, October 27, 2005. Comments for inclusion on the Rules Docket must be received on or before July 30, 2005.
