were amended to reflect the new
determination. On February 14, 2005,
Canada alleged that the United States
had not properly implemented the
recommendations and rulings and
requested the establishment of a dispute
settlement panel under Article 21.5 of
the DSU to review this implementation.
The panel was established on February
25, 2005.
In its request under Article 21.5,
Canada alleges that the ITC failed to
implement the recommendations and
rulings of the DSB by (1) failing to make
a determination of threat of material
injury based on facts; (2) failing to
demonstrate a causal relationship
between allegedly dumped and
subsidized imports of softwood lumber
from Canada and threatened injury to
the domestic industry; and (3) failing to
examine in an unbiased and objective
manner any and all known factors other
than the allegedly dumped and
subsidized imports that were injuring or
threatening to injure the domestic
industry.
The specific measures identified by
Canada as inconsistent with U.S. WTO
obligations under the AD Agreement
and SCM Agreement are: (1) Section 129
Consistency Determination, Softwood
Lumber from Canada, (24 Nov. 2004),
Inv. Nos. 701–TA–414 and 731–TA–
928; and (2) Notice of Amendment to
Antidumping and Countervailing Duty
Orders on Certain Softwood Lumber
Products From Canada (20 Dec. 2004),
69 FR 75917 (Dep’t. Commerce,
December 20, 2004).
The European Communities and the
People’s Republic of China have
indicated their interest to participate in
the dispute as third parties.

the issues raised in this dispute. Persons
submitting comments may either send

Interested persons who make

information that might appear in a cover

contained in a comment submitted by

information must be clearly designated
as such and the submission must be
marked ‘‘Business Confidential’’ at the
top and bottom of the cover page and
each succeeding page of the submission.
Information or advice contained in a
comment submitted, other than business
confidential information, may be
determined by USTR to be confidential
in accordance with section 135(g)(2) of
the Trade Act of 1974 (19 U.S.C.
2155(g)(2)). If the submitting person
believes that information or advice may
qualify as such, the submitting person—
(1) Must clearly so designate the
information or advice;
(2) Must clearly mark the material as
‘‘Submitted in Confidence’’ at the top
and bottom of each page of the cover
page and each succeeding page; and
(3) Is encouraged to provide a nonconfidential summary of the
information or advice.

URAA (19 U.S.C. 3537(e)), USTR will

settlement proceeding, accessible to the

respect to the dispute; if a dispute
settlement panel is convened, the U.S.
submissions to that panel, the
submissions, or non-confidential

dispute, as well as the report of the
panel; and, if applicable, the report of
the Appellate Body. An appointment to
