L. 97–451, Benson-Montin-Greer timely filed a petition for reinstatement of oil and gas lease NMNM 009954 for lands in Rio Arriba County, New Mexico, and it was accompanied by all required rentals and royalties accruing from August 1, 2004, the date of termination. The Lessee has met all the requirements for reinstatement of the lease as set out in sections 31(d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188), and the Bureau of Land Management is proposing to reinstate the lease effective August 1, 2004, subject to the original terms and conditions of the lease and the increased rental and royalty rates cited above. Appropriation of any of the land described in this order under the general mining laws prior to the date and time of restoration is unauthorized. Any such attempted appropriation, including attempted adverse possession under 30 U.S.C 38 (2000), shall vest no rights against the United States. Acts required to establish a location and to initiate a right of possession are governed by State law where not in conflict with Federal law. The Bureau of Land Management will not intervene in disputes between rival locators over possessory rights since Congress has provided for such determinations in local courts.
