On March 3, 2005, the Commission
issued an order in the above-referenced
dockets initiating a proceeding in
Docket No. EL05–67–000 under section
206 of the Federal Power Act to
determine whether The Empire District
Electric Company may continue to
charge market-based rates.
The refund effective date in Docket
No. EL05–67–000, established pursuant
to section 206 of the Federal Power Act,
will be 60 days following publication of
this notice in the Federal Register.

Paso Natural Gas Company (El Paso)
tendered for filing as part of its FERC
Gas Tariff, Second Revised Volume No.
1–A, Fourth Revised Sheet No. 2, to
become effective April 1, 2005.
El Paso states that it is submitting a
Precedent Agreement and related
documents for the Commission’s review
and acceptance and has listed the
agreement on Sheet No. 2 of its tariff.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211 and
385.214). Protests will be considered by
