Federal Register / Vol. 70, No. 49 / Tuesday, March 15, 2005 / Proposed Rules
EPA has also determined that this
proposed rule contains no regulatory
requirements that might significantly or
uniquely affect small government
entities. Thus, the requirements of
section 203 of the UMRA do not apply
to this rule.
5. Executive Order 13132: Federalism
Executive Order 13132, entitled
‘‘Federalism’’ (64 FR 43255, August 10,
1999), requires EPA to develop an
accountable process to ensure
‘‘meaningful and timely input by State
and local officials in the development of
regulatory policies that have federalism
implications.’’ ‘‘Policies that have
federalism implications’’ is defined in
the Executive Order to include
regulations that have ‘‘substantial direct
effects on the States, on the relationship
between the national government and
the States, or on the distribution of
power and responsibilities among
various levels of government.’’ This
proposed rule, a technical correction,
does not have federalism implications.
It will not have substantial direct effects
on the States, on the relationship
between the national government and
the States, or on the distribution of
power and responsibilities among
various levels of government, as
specified in Executive Order 13132.
Thus, Executive Order 13132 does not
apply to this rule.
6. Executive Order 13175: Consultation
and Coordination With Indian Tribal
Governments
Executive Order 13175, entitled
‘‘Consultation and Coordination with
Indian Tribal Governments’’ (65 FR
67249, November 9, 2000), requires EPA
to develop an accountable process to
ensure ‘‘meaningful and timely input by
tribal officials in the development of
regulatory policies that have tribal
implications.’’ This proposed rule does
not have tribal implications, as specified
in Executive Order 13175. The proposed
rule is a technical correction and does
not establish any regulatory policy with
tribal implications. Thus, Executive
Order 13175 does not apply to this
proposed rule.
7. Executive Order 13045: Protection of
Children From Environmental Health
and Safety Risks
Executive Order 13045 applies to any
rule that: (1) Is determined to be
‘‘economically significant’’ as defined
under Executive Order 12866, and (2)
concerns an environmental health or
safety risk that EPA has reason to
believe may have a disproportionate
effect on children. If the regulatory
action meets both criteria, the Agency
VerDate jul<14>2003

Jkt 205001
must evaluate the environmental health
or safety effects of the planned rule on
children, and explain why the planned
regulation is preferable to other
potentially effective and reasonably
feasible alternatives considered by the
Agency. This proposed rule is not
subject to Executive Order 13045
because it is not economically
significant as defined in Executive
Order 12866 and because the Agency
does not have reason to believe the
environmental health or safety risks
addressed by this proposed action, a
technical correction, present a
disproportionate risk to children.
8. Executive Order 13211: Actions That
Significantly Affect Energy Supply,
Distribution or Use
This rule is not subject to Executive
Order 13211, ‘‘Actions Concerning
Regulations that Significantly Affect
Energy Supply, Distribution, or Use’’ (66
FR 28355, May 22, 2001) because it is
not a ‘‘significant regulatory action’’ as
defined under Executive Order 12866.
9. National Technology Transfer and
Advancement Act
Section 12(d) of the National
Technology Transfer and Advancement
Act of 1995 (‘‘NTTAA’’), Public Law
104–113, 12(d) (15 U.S.C. 272) directs
EPA to use voluntary consensus
standards in its regulatory activities
unless to do so would be inconsistent
with applicable law or otherwise
impractical. Voluntary consensus
standards are technical standards (e.g.,
materials specifications, test methods,
sampling procedures, and business
practices) that are developed or adopted
by voluntary consensus bodies. The
NTTAA directs EPA to provide
Congress, through the OMB,
explanations when the Agency decides
not to use available and applicable
voluntary consensus standards. This
proposed rulemaking is a technical
correction and does not involve
technical standards.
10. Executive Order 12898: Federal
Actions To Address Environmental
Justice in Minority Populations and Low
Income Populations
To the greatest extent practicable and
permitted by law, and consistent with
the principles set forth in the report on
the National Performance Review, each
Federal agency must make achieving
environmental justice part of its mission
by identifying and addressing, as
appropriate, disproportionately high
and adverse human health and
environmental effects of its programs,
policies, and activities on minority
populations and low-income

populations in the United States and its
territories and possessions, the District
of Columbia, the Commonwealth of
Puerto Rico, and the Commonwealth of
the Mariana Islands. Because this
proposed rule is a technical correction
with no anticipated significant adverse
human health or environmental effects,
the rule is not subject to Executive
Order 12898.

its hazardous waste program under the
Resource Conservation and Recovery
Act (RCRA). EPA proposes to grant final
authorization to Alabama for RCRA
Clusters VIII through XII. In the ‘‘Rules
and Regulations’’ section of this Federal
Register, EPA is authorizing the changes
by an immediate final rule. EPA did not
make a proposal prior to the immediate
final rule because we believe this action
is not controversial and do not expect
comments that oppose it. We have
explained the reasons for this
authorization in the preamble to the
immediate final rule. Unless we get
written comments which oppose this
authorization during the comment
period, the immediate final rule will
become effective on the date it
establishes, and we will not take further
action on this proposal. If we get
comments that oppose this action, we
will withdraw the immediate final rule
and it will not take effect. We will then
respond to public comments in a later
final rule based on this proposal. You
may not have another opportunity for
comment. If you want to comment on
this action, you must do so at this time.

SUPPLEMENTARY INFORMATION:
I. Background
Pursuant to 49 U.S.C. 33112, Insurer
reports and information, NHTSA
requires certain passenger motor vehicle
insurers to file an annual report with the
agency. Each insurer’s report includes
information about thefts and recoveries
of motor vehicles, the rating rules used
by the insurer to establish premiums for
comprehensive coverage, the actions
taken by the insurer to reduce such
premiums, and the actions taken by the
insurer to reduce or deter theft. Under
the agency’s regulation, 49 CFR part
544, the following insurers are subject to
the reporting requirements:
(1) Issuers of motor vehicle insurance
policies whose total premiums account
for 1 percent or more of the total
premiums of motor vehicle insurance
issued within the United States;
(2) Issuers of motor vehicle insurance
policies whose premiums account for 10
percent or more of total premiums
written within any one State; and
(3) Rental and leasing companies with
a fleet of 20 or more vehicles not
covered by theft insurance policies
issued by insurers of motor vehicles,
other than any governmental entity.
Pursuant to its statutory exemption
authority, the agency exempted certain
passenger motor vehicle insurers from
the reporting requirements.
A. Small Insurers of Passenger Motor
Vehicles
Section 33112(f)(2) provides that the
agency shall exempt small insurers of
passenger motor vehicles if NHTSA
finds that such exemptions will not
significantly affect the validity or
usefulness of the information in the
reports, either nationally or on a state-
