SUPPLEMENTARY INFORMATION: The
Commission instituted this investigation
on April 14, 2004, based on a complaint
filed on behalf of Zoran Corporation and
Oak Technology, Inc. both of
Sunnyvale, CA (collectively
‘‘complainants’’). 69 FR 19876. The
complaint, as supplemented, alleged
violations of section 337 of the Tariff
Act of 1930 in the importation into the
United States, the sale for importation,
and the sale within the United States
after importation of certain optical disk
controller chips and chipsets and
products containing same, including
DVD players and PC optical storage
devices, by reason of infringement of
claims 1–12 of U.S. Patent No. 6,466,736
(the ‘‘736 patent), claims 1–3 of U.S.
Patent No. 6,584,527, and claims 1–35
of U.S. Patent No. 6,546,440 (the ‘‘440
patent). The notice of investigation
identified 12 respondents. On June 7,
2004, the ALJ issued an ID (Order No.
5) terminating the investigation as to
two respondents on the basis of a
consent order and settlement agreement.
On June 22, 2004, the ALJ issued an ID
(Order No. 7) granting complainants’
motion to amend the complaint and
notice of investigation to add nine
additional respondents. On December
22, 2004, the ALJ issued an ID (Order
No. 33) granting complainants’ motion
to terminate the investigation in part
with respect to claims 2–6, 8–10, and 11
of the ‘‘736 patent and claims 2–4, 6, 9,
11, 12, 15–18, 20, 22–34, and 35 of the
‘‘440 patent. Those IDs were not
reviewed by the Commission.
On January 21, 2005, complainants
moved pursuant to Commission rule
210.21(a) to terminate the investigation
in part by withdrawing the infringement
allegations as to claim 12 of the ‘‘736
patent. No responses to the motion were
filed.
On January 28, 2005, the ALJ issued
an ID (Order No. 37) granting the
motion.
No petitions for review of the ID were
filed.
The authority for the Commission’s
determination is contained in section
337 of the Tariff Act of 1930, as
amended (19 U.S.C. § 1337), and in
section 210.42 of the Commission’s
Rules of Practice and Procedure (19 CFR
210.42).

Outboard Engines From Japan
Determination
On the basis of the record 1 developed
in the subject investigation, the United
States International Trade Commission
(Commission) determines,2 pursuant to
section 735(b) of the Tariff Act of 1930
(19 U.S.C. 1673d(b)) (the Act), that an
industry in the United States is not
materially injured or threatened with
material injury, and the establishment of
an industry in the United States is not
materially retarded, by reason of
imports from Japan of outboard engines
and powerheads, provided for in
subheading 8407.21.00 of the
Harmonized Tariff Schedule of the
United States, that have been found by
the Department of Commerce
(Commerce) to be sold in the United
States at less than fair value (LTFV).
Background
The Commission instituted this
investigation effective January 8, 2004,
following receipt of a petition filed with
the Commission and Commerce by
Mercury Marine, a division of
Brunswick Corp., Fond du Lac, WI. The
final phase of the investigation was
scheduled by the Commission following
notification of a preliminary
determination by Commerce that
imports of outboard engines from Japan
were being sold at LTFV within the
meaning of section 733(b) of the Act (19
U.S.C. 1673b(b)). Notice of the
scheduling of the final phase of the
Commission’s investigation and of a
public hearing to be held in connection
therewith was given by posting copies
of the notice in the Office of the
Secretary, U.S. International Trade
Commission, Washington, DC, and by
publishing the notice in the Federal
Register of August 23, 2004 (69 FR
51859).3 The hearing was held in
Washington, DC, on December 14, 2004,
and all persons who requested the
opportunity were permitted to appear in
person or by counsel.
The Commission transmitted its
determination in this investigation to
the Secretary of Commerce on February
17, 2004. The views of the Commission
are contained in USITC Publication
