SUPPLEMENTARY INFORMATION: On October 13, 2004, notice was published in the Federal Register (69 FR 60841) that an amendment of permit no. 782– 1702–02 and modification of permit no. 1409 had been requested by the abovenamed organization and individual. The requested amendment and modification have been granted under the authority of the Marine Mammal Protection Act of 1972, as amended (16 U.S.C. 1361 et seq.), the Regulations Governing the Taking and Importing of Marine Mammals (50 CFR part 216), the Endangered Species Act of 1973, as amended (ESA; 16 U.S.C. 1531 et seq.), and the regulations governing the taking, importing, and exporting of endangered and threatened species (50 CFR 222–226), and the Fur Seal Act of 1966, as amended (16 U.S.C. 1151 et seq.). Permit Amendment Permit No. 782–1702–03 authorizes an increase in the number of California sea lions (Zalophus californianus) that may be accidentally killed from five per year to seven for the year spanning July 1, 2004 to June 30, 2005 (starting July 1, 2005, the authorized accidental mortality would revert to five annually). Permit Modification Permit No. 1409–01 authorizes attachment of sonic tags to 15 green sea turtles (Chelonia mydas) to document the movements, foraging locations, behavior, resting sites, and daily movement patterns in nearshore reefs in central Brevard County. In compliance with the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), a final determination has been made that the activity proposed in permit 782–1702– 03 is categorically excluded from the requirement to prepare an environmental assessment or environmental impact statement.
