The Acting Assistant Secretary for Educational and Cultural Affairs, United States Department of State, determined that conditions warrant the imposition of emergency restrictions on categories of archaeological material and ethnological material of the cultural heritage of Afghanistan. This document contains the Designated List of Archaeological and Ethnological Material of Afghanistan that describes the types of objects or categories of archaeological and ethnological material to which the import restrictions apply. The emergency import restrictions imposed on certain archaeological and ethnological material of Afghanistan will be in effect until April 28, 2026, unless extended. These restrictions are being imposed pursuant to determinations of the United States Department of State made under the terms of the Convention on Cultural Property Implementation Act.

Argentina Beef Imports Approved for the Electronic Certification System (eCERT)

This document announces that the export certification requirement for certain imports of beef from the Argentine Republic (Argentina) subject to a tariff-rate quota will be accomplished through the Electronic Certification System (eCERT). All imports of beef from Argentina that are subject to the tariff-rate quota must have a valid export certificate with a corresponding eCERT transmission at the time of entry, or withdrawal from warehouse, for consumption. In this final rule, the Department of Homeland Security (DHS) makes the 2022 annual inflation adjustment to its civil monetary penalties. On November 2, 2015, the President signed into law The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (the 2015 Act). Pursuant to the 2015 Act, all agencies must adjust their civil monetary penalties annually and publish the adjustment in the Federal Register. Accordingly, this final rule adjusts the Department's civil monetary penalties for 2021 pursuant to the 2015 Act and Executive Office of the President (EOP) Office of Management and Budget (OMB) guidance. The new penalties will be effective for penalties assessed after January 11, 2022 whose associated violations occurred after November 2, 2015.

This rule amends the regulations in title 8 and title 19 of the Code of Federal Regulations (CFR) regarding the submission of U.S. Customs and Border Protection (CBP) Form I-418, Passenger ListCrew List (Form I-418) in paper form. Currently, the master or agent of every commercial vessel arriving in the United States, with limited exceptions, must submit Form I-418, along with certain information regarding longshore work, in paper form to CBP at the port where immigration inspection is performed. Most commercial vessel operators are also required to submit a paper Form I-418 to CBP at the final U.S. port prior to departing for a foreign place. DHS is modifying the applicable regulations to provide for the electronic submission of Form I-418. Under this rule, vessel operators will be required to electronically submit the data elements on Form I-418 to CBP through an electronic data interchange system (EDI) approved by CBP in lieu of submitting a paper form. This will streamline vessel arrival and departure processes by providing for the electronic submission of the information collected on the Form I-418, eliminating redundant data submissions, simplifying vessel inspections, and automating recordkeeping.

This final rule amends the U.S. Customs and Border Protection (CBP) regulations to reflect an extension and amendment of import restrictions on certain archaeological material and the imposition of import restrictions on ethnological material of the Arab Republic of Egypt (Egypt). The restrictions on archaeological material, which were originally imposed by CBP Dec. 16-23, were extended and amended on November 30, 2021. The Acting Assistant Secretary for Educational and Cultural Affairs, United States Department of State, has made the requisite determinations for extending and updating the import restrictions that previously existed, and the Governments of the United States and Egypt entered into a new agreement to reflect the extension of these import restrictions. Additionally, the Acting Assistant Secretary for Educational and Cultural Affairs, United States Department of State, has made the requisite determinations for adding import restrictions on certain categories of ethnological material. The new agreement, which entered into force on November 30, 2021, supersedes the existing Memorandum of Understanding (MOU) that became effective on November 30, 2016, and enabled the promulgation of the existing import restrictions. Accordingly, the current import restrictions and new import restrictions will be effective until November 30, 2026, and the CBP regulations are being amended to reflect this extension and imposition. To fulfill the terms of the new MOU, the Designated List of cultural property, which was described in CBP Dec. 16-23, is amended in this document to reflect the addition and revision of categories of archaeological material of Egypt ranging in date from approximately 300,000 B.C. to A.D. 1750, and to include certain ethnological material ranging from A.D. 1517 to 1914.

The restrictions, which were originally imposed by Treasury Decision (T.D.) 01-86 and last extended by CBP Decision (CBP Dec.) 16-24, are due to expire on December 4, 2021. The Acting Assistant Secretary for Educational and Cultural Affairs, United States Department of State, has determined that factors continue to warrant the imposition of import restrictions and no cause for suspension exists. Pursuant to the exchange of diplomatic notes to extend the agreement, the import restrictions will remain in effect for an additional five years, and the CBP regulations are being amended to reflect this further extension until December 4, 2026. T.D. 01-86 contains the Designated List of archaeological and ethnological material from Bolivia to which the restrictions apply.

This document provides notice to customs brokers that the annual user fee that is assessed for each permit held by a broker, whether it may be an individual, partnership, association, or corporation, is due by January 31, 2022. Pursuant to fee adjustments required by the Fixing America's Surface Transportation Act (FAST ACT) and U.S. Customs and Border Protection (CBP) regulations, the annual user fee payable for calendar year 2022 will be $153.19.
Extension and Amendment of Import Restrictions Imposed on Archaeological and Ethnological Material of Greece

This final rule amends the U.S. Customs and Border Protection (CBP) Regulations to reflect an extension and amendment of import restrictions on certain archaeological and ecclesiastical ethnological material of the Hellenic Republic (Greece). The restrictions, which were originally imposed by CBP Dec. 11-25 and last extended in CBP Dec. 16-21, are due to expire on November 21, 2021. The Acting Assistant Secretary for Educational and Cultural Affairs, United States Department of State, has made the requisite determinations for extending the import restrictions that previously existed, and the Government of the United States and the Government of Greece entered into a new agreement to reflect the extension of these import restrictions. The new agreement, which enters into force on November 21, 2021, supersedes the existing Memorandum of Understanding (MOU) that became effective on November 21, 2016, and enabled the promulgation of the existing import restrictions. Accordingly, the import restrictions will remain in effect for an additional five years, and the CBP regulations are being amended to reflect this extension until November 21, 2026. To fulfill the terms of the new MOU, the Designated List of cultural property, which was described in CBP Dec. 11-25, is amended in this document to correct certain typographical errors, to add certain coins from the Byzantine and Medieval periods, to clarify pottery styles, and to include post-Byzantine ethnological material dating up to A.D. 1830.

This document amends U.S. Customs and Border Protection (CBP) regulations by removing one airport from the list of user fee airports. User fee airports are airports that have been approved by the Commissioner of CBP to receive, for a fee, the customs services of CBP officers for processing aircraft, passengers, and cargo entering the United States, but do not qualify for designation as international or landing rights airports. Specifically, this technical amendment reflects the removal of the designation of user fee airport status for the Charlotte-Monroe Executive Airport in Monroe, North Carolina.
