China: Government Policies Affecting U.S. Trade in Selected Sectors
Following receipt of a request dated May 23, 2007 (received May 29, 2007) from the Committee on Ways and Means of the U.S. House of Representatives (Committee) for a series of three reports under section 332(g) of the Tariff Act of 1930 (19 U.S.C. (332(g)) on U.S.-China trade, the U.S. International Trade Commission (Commission) instituted investigation No. 332-491, China: Government Policies Affecting U.S. Trade in Selected Sectors, for the purpose of preparing the second report.
Individually Quick Frozen Red Raspberries From Chile
The subject five-year review was initiated in June 2007 to determine whether revocation of the antidumping duty order on individually quick frozen red raspberries from Chile would be likely to lead to continuation or recurrence of material injury. On July 20, 2007, the Department of Commerce published notice that it was revoking the order effective July 9, 2007, ``{b{time} ecause the domestic interested parties did not participate in this review'' (72 FR 39793). Accordingly, pursuant to section 751(c) of the Tariff Act of 1930 (19 U.S.C. 1675(c)), the subject review is terminated.
Request for Comments Concerning the Institution of a Section 751(b) Review Investigation; Certain Orange Juice From Brazil
The Commission invites comments from the public on whether changed circumstances exist sufficient to warrant the institution of an investigation pursuant to section 751(b) of the Tariff Act of 1930 (19 U.S.C. 1675(b)) (the Act) to review the Commission's affirmative determination in investigation No. 731-TA-1089 (Final). The purpose of the proposed review investigation is to determine whether revocation of the existing antidumping duty order on imports of certain orange juice from Brazil is likely to lead to continuation or recurrence of material injury. See 19 U.S.C. 1675(b)(2)(A). Certain orange juice is provided for in subheadings 2009.11.00, 2009.12.25, and 2009.19.00 of the Harmonized Tariff Schedule of the United States.
Hot-Rolled Steel Products From the Netherlands
On August 1, 2006, the Department of Commerce (``Commerce'') initiated and the U.S. International Trade Commission (``Commission'') instituted a five-year review concerning the antidumping duty order on hot-rolled steel products (``hot-rolled steel'') from the Netherlands. 71 FR 43443 and 71 FR 43521. However, on May 4, 2007, Commerce published notice in the Federal Register of the implementation of the findings of the World Trade Organization Panel under section 129 of the Uruguay Round Agreements Act and the revocation of the antidumping duty order concerning hot-rolled steel from the Netherlands effective April 23, 2007. 72 FR 25261. On June 27, 2007, Commerce published notice in the Federal Register of its final results of the sunset review of the antidumping duty order on hot-rolled steel from the Netherlands. 72 FR 35220. In that notice, Commerce determined that a finding of likelihood in a sunset review ``presumes the existence of an antidumping duty order currently in force, which is manifestly not the case here. Consequently, in the absence of an order currently in force, the Department cannot make a finding that it is likely that dumping will continue or recur if the order is revoked.'' 72 FR 35221. Commerce further stated that it was revoking the antidumping duty order on hot- rolled steel from the Netherlands effective November 29, 2006, the fifth anniversary of the date of publication of the order. Accordingly, pursuant to section 751(c) of the Tariff Act of 1930 (19 U.S.C. 1675(c)), the five-year review of the antidumping duty order concerning hot-rolled steel from the Netherlands (investigation No. 731-TA-903 (Review)) is terminated.
In the Matter of Certain Nor and Nand Flash Memory Devices and Products Containing the Same; Notice of Commission Decision Not To Review the Initial Determination of No Violation of Section 337 and Recommended Determination on Remedy and Bond; Termination of Investigation
Notice is hereby given that the U.S. International Trade Commission has determined not to review a final initial determination (``ID'') issued by the presiding administrative law judge (``ALJ'') regarding whether there is a violation of section 337 of the Tariff Act of 1930 in the above-captioned investigation.
Certain Off-the-Road Tires From China
On June 18, 2007, the Commission established a schedule for the conduct of the subject investigations (72 FR 30831, June 4, 2007). Subsequently, the Department of Commerce extended the date for its initiation of the investigations from July 9 to July 30, 2007. The Commission, therefore, is revising its schedule to conform with Commerce's new schedule. The Commission's new schedule for the investigations is as follows: the deadline for filing written briefs is July 17, 2007, and the administrative deadline for transmitting determinations and views to Commerce is August 27, 2007. For further information concerning the conduct of these investigations and rules of general application, consult the Commission's Rules of Practice and Procedure, part 201, subparts A through E (19 CFR part 201), and part 207, subparts A and B (19 CFR part 207).
Sub-Saharan Africa: Factors Affecting Trade Patterns of Selected Industries-Second Annual Report
In a letter dated July 26, 2006, the United States Trade Representative (USTR) requested, under section 332(g) of the Tariff Act of 1930 (19 U.S.C. 1332(g)), that the U.S. International Trade Commission (Commission) prepare three annual reports relating to factors that affect trade patterns of selected industries in sub- Saharan African (SSA) countries. In response, the Commission instituted investigation No. 332-477, Sub-Saharan Africa: Factors Affecting Trade Patterns of Selected Industries, and delivered its first report on April 3, 2007. This notice announces the scheduling of the second report in this series, the industries to be covered, and the scheduling of a public hearing.
In the Matter of Certain High-Brightness Light Emitting Diodes and Products Containing Same Notice of Commission Decision To Reverse-In-Part and Modify-In-Part a Final Initial Determination Finding a Violation of Section 337; Issuance of a Limited Exclusion Order; and Termination of the Investigation.
Notice is hereby given that the U.S. International Trade Commission has determined to reverse-in-part and modify-in-part a final initial determination (``ID'') of the presiding administrative law judge (``ALJ'') finding a violation of section 337 by the respondent's products in the above-captioned investigation, and has issued a limited exclusion order directed against products of respondent Epistar Corporation (``Epistar'') of Hsinchu, Taiwan.
Canned Peaches, Pears, and Fruit Mixtures: Conditions of Competition Between U.S. and Principal Foreign Supplier Industries
On July 2, 2007, the only scheduled witness for the hearing in investigation No. 332-485, Canned Peaches, Pears, and Fruit Mixtures: Conditions of Competition between U.S. and Principal Foreign Supplier Industries, scheduled for July 12, 2007, withdrew his request to appear. Therefore, the public hearing in this investigation has been canceled. Background: The Commission published notice of institution of the investigation and hearing in the Federal Register on February 13, 2007 (72 FR 6744). The notice asked that persons interested in appearing at the hearing file their requests by the close of June 28, 2007, and stated that the hearing would be canceled if no requests were received by that date. One request was received by the June 28 deadline, but it was subsequently withdrawn on July 2, 2007. Accordingly, the Commission has canceled the hearing. All other information about the investigation, including a description of the subject matter to be addressed, contact information, and procedures relating to written submissions, remains the same as in the original notice. Wood Flooring and Hardwood Plywood: Competitive Conditions Affecting the U.S. Industries
The Commission has rescheduled the public hearing in this investigation from September 13, 2007, to October 3, 2007. As announced in the notice of institution of the investigation published in the Federal Register on April 20, 2007 (72 FR 19960), the hearing will be held at the U.S. International Trade Commission Building, 500 E Street, SW., Washington, DC; it will begin at 9:30 a.m. Certain dates relating to the filing of written statements and other documents have been changed; the revised schedule of dates is set out immediately below. All other requirements and procedures set out in the notice published on April 20, 2007, continue to apply. In the event that, as of the close of business on September 12, 2007, no witnesses are scheduled to appear at the hearing, the hearing will be canceled. Any person interested in attending the hearing as an observer or nonparticipant may call the Secretary to the Commission (202-205-2000) after September 12, 2007, for information concerning whether the hearing will be held.
In the Matter of Certain Endodontic Instruments; Notice of Investigation
Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on June 5, 2007, under section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. 1337, on behalf of Dentsply International Inc. of York, Pennsylvania. A supplement to the complaint was filed on June 22, 2007. The complaint, as supplemented, alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain endodontic instruments by reason of infringement of U.S. Patent Nos. 5,628,674 and 6,206,695. The complaint, as supplemented, further alleges that an industry in the United States exists as required by subsection (a)(2) of section 337. The complainant requests that the Commission institute an investigation and, after the investigation, issue a permanent exclusion order and permanent cease and desist order.
In the Matter of Certain Nitrile Gloves; Notice of Investigation
Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on May 30, 2007, under section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. 1337, on behalf of Tillotson Corporation d/b/a Best Manufacturing Company of Menlo, Georgia. The complaint alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain nitrile gloves by reason of infringement of U.S. Patent No. Re. 35,616. The complaint further alleges that an industry in the United States exists as required by subsection (a)(2) of section 337. The complainant requests that the Commission institute an investigation and, after the investigation, issue a permanent general exclusion order and permanent cease and desist orders.
In the Matter of Certain Buffer Systems and Components Thereof Used in Container Processing Lines; Notice of Investigation
Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on May 31, 2007, under section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. 1337, on behalf of Sidel Participations of France, Sidel Canada Inc. of Canada, and Sidel Inc. of Norcross, Georgia. A supplement to the complaint was filed on June 18, 2007. The complaint, as supplemented, alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain buffer systems and components thereof used in container processing lines by reason of infringement of U.S. Patent No. 6,168,005. The complaint, as supplemented, further alleges that a domestic industry exists in the United States as required by subsection (a)(2) of section 337. The complainants request that the Commission institute an investigation and, after the investigation, issue a permanent general exclusion order and permanent cease and desist orders.

Laminated Woven Sacks From China
The Commission hereby gives notice of the institution of investigations and commencement of preliminary phase antidumping and countervailing duty investigation Nos. 701-TA-450 and 731-TA-1122 (Preliminary) under section 703(a) (19 U.S.C. 1671b(a)) and section 733(a) of the Tariff Act of 1930 (19 U.S.C. 1673b(a)) (the Act) to determine whether there is a reasonable indication that an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports from China of laminated woven sacks, provided for in subheading 6305.33.0020 of the Harmonized Tariff Schedule of the United States, that are alleged to be sold in the United States at less than fair value and subsidized by the Government of China. Unless the Department of Commerce extends the time for initiation pursuant to section 702(c)(1)(B) or 732(c)(1)(B) of the Act (19 U.S.C. 1671a(c)(1)(B) or 1673a(c)(1)(B)), the Commission must reach a preliminary determination in antidumping and countervailing duty investigations in 45 days, or in this case by August 13, 2007. The Commission's views are due at Commerce within five business days thereafter, or by August 20, 2007. The Commission hereby gives notice of the institution of investigation and commencement of preliminary phase countervailing duty investigation No. 701-TA-449 (Preliminary) under section 703(a) of the Tariff Act of 1930 (19 U.S.C. 1671b(a)) (the Act) to determine whether there is a reasonable indication that an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports from China of light-walled rectangular pipe and tube, currently provided for in subheading 7306.61.50 of the Harmonized Tariff Schedule of the United States,\1\ that are alleged to be subsidized by the Government of the People's Republic of China. The Commission also hereby gives notice of the institution of investigations and commencement of preliminary phase antidumping investigations Nos. 731-TA-1118-1121 (Preliminary) under section 733(a) of the Tariff Act of 1930 (19 U.S.C. 1673b(a)) (the Act) to determine whether there is a reasonable indication that an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports from China, Korea, Mexico, and Turkey of light-walled rectangular pipe and tube, currently provided for in subheading 7306.61.50 of the Harmonized Tariff Schedule of the United States,\1\ that are alleged to be sold in the United States at less than fair value. Unless the Department of Commerce extends the time for initiation pursuant to section 702(c)(1)(B) of the Act (19 U.S.C. 1671a(c)(1)(B)), the Commission must reach preliminary determinations in antidumping and countervailing duty investigations in 45 days, or in this case by Monday, August 13, 2007. The Commission hereby gives notice that it has instituted a review pursuant to section 751(c) of the Tariff Act of 1930 (19 U.S.C. 1675(c)) (the Act) to determine whether revocation of the antidumping duty order on brake rotors from China would be likely to lead to continuation or recurrence of material injury. Pursuant to section 751(c)(2) of the Act, interested parties are requested to respond to this notice by submitting the information specified below to the Commission; \1\ to be assured of consideration, the deadline for responses is August 21, 2007.
