We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on a petition to delist the coastal California gnatcatcher (Polioptila californica californica) and a petition to list the monarch butterfly (Danaus plexippus plexippus) under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that both petitions present substantial scientific or commercial information indicating that the petitioned actions may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of these subspecies to determine if the petitioned actions are warranted. To ensure that these status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding these subspecies. Based on the status reviews, we will issue 12-month findings on the petitions, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

The NPS is considering this proposal to address erosion issues and prevent future emergency closure of these areas of Highway 12 due to storm impacts to the road in this narrow area of Hatteras Island. The Federal Geographic Data Committee (FGDC) is conducting a public review of the draft Part 2 (revision), Digital Orthoimagery, of the FGDC Geographic Information Framework Data Standard. The primary purpose of Part 2, Digital Orthoimagery, of the FGDC Geographic Information Framework Data Content Standard is to support exchange of orthoimagery data. Part 2 seeks to establish a common baseline for the semantic content of orthoimagery databases for public agencies and private enterprises. It also seeks to decrease the costs and simplify the exchange of orthoimagery data among local, Tribal, State, and Federal users and producers. That, in turn, discourages duplicative data collection. Benefits of adopting Part 2 also include the long-term improvement of geospatial orthoimagery data within the community. We, the U.S. Fish and Wildlife Service (Service or ``we''), announce the availability of an application for an Incidental Take Permit (ITP) and a proposed Habitat Conservation Plan (HCP) from the Town of Orleans (Town) for public review and comment. We received the permit application from the Town for incidental take of the threatened piping plover (Charadrius melodus) resulting from the Town's authorization and management of over-sand vehicle (OSV) activities over the next 3 years. Our preliminary determination is that the proposed HCP qualifies as low-effect under our final Handbook for Habitat Conservation Planning and Incidental Take Permitting Process. To make this determination, we used our Low-Effect HCP Screening Form/ Environmental Action Statement (EAS), the preliminary version of which is also available for review. We provide this notice to (1) seek public comments on the proposed HCP and application; (2) seek public comments on our preliminary determination that the HCP qualifies as low-effect and is therefore eligible for a categorical exclusion under the National Environmental Policy Act (NEPA); and (3) advise other Federal and State agencies, affected Tribes, and the public of our intent to issue an ITP.

This joint interim final rule implements for all Federal award-making agencies the final guidance Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance) published by the Office of Management and Budget (OMB) on December 26, 2013. This rule is necessary in order to incorporate into regulation and thus bring into effect the Uniform Guidance as required by OMB. Implementation of this guidance will reduce administrative burden and risk of waste, fraud, and abuse for the approximately $600 billion per year awarded in Federal financial assistance. The result will be more Federal dollars reprogrammed to support the mission, new entities able to compete and win awards, and ultimately a stronger framework to provide key services to American citizens and support the basic research that underpins the United States economy.

North Dakota Regulatory Program

We are approving an amendment to the North Dakota regulatory program (the ``North Dakota program'') under the Surface Mining Control and Reclamation Act of 1977 (``SMCRA'' or ``the Act''). North Dakota intends to revise its program to be consistent with the corresponding Federal regulations. North Dakota submitted the amendment to address required rule changes OSMRE identified by letter to North Dakota dated October 2, 2009, under 30 CFR 732.17(c). These include changes to North Dakota's rules regarding use of the Applicant Violator System (AVS) and ownership and control. North Dakota has met all of the conditions outlined in the 732 letter and has included all applicable revisions and/or additions to their rules. North Dakota is also proposing to add a new subsection to an existing rule with general requirements relating to the format of electronic applications. They are also making a minor correction to another rule pertaining to the term of permits to make it consistent with a separate rule which was previously amended to no longer require renewal of a permit once lands in that permit are no longer being mined or used in the support of surface coal mining.
