The U.S. Army Corps of Engineers (COE), Wilmington District, Wilmington Regulatory Field Office has received a request for Department of the Army authorization, pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbor Act, from Carteret County to implement, under an inter-local agreement between the towns on Bogue Banks barrier island, a comprehensive 50-year beach and inlet management plan for the protection of approximately 25 miles of Bogue Banks shoreline. In order to address ongoing shoreline erosion in a more effective manner, the County and island municipalities (Towns of Atlantic Beach, Pine Knoll Shores, Indian Beach, and Emerald Isle) are proposing to combine their shore protection efforts under a more efficient comprehensive 50-year beach and inlet management plan known as the Bogue Banks Master Beach Nourishment Plan (BBMBNP).

The U.S. Army Corps of Engineers (Corps) is amending its regulations by revising an existing restricted area regulation and establishing a new restricted area along portions of the Tyndall Air Force Base (AFB) facility shoreline that will be activated on a temporary basis. The duration of temporary restricted area activations will be limited to those periods where it is warranted or required by specific and credible security threats and will be inactive at all other times. The restricted area will be partitioned using 23 pairs of coordinates to facilitate quick geographic recognition. Tyndall AFB is surrounded on three sides by water with approximately 129 miles of unprotected coastline. This includes several areas where the lack of security or lack of restriction on access to these areas leaves Tyndall AFB personnel and resources vulnerable to security threats. This amendment is necessary to implement an enhanced threat security plan for Tyndall AFB which will allow temporary activation of one or more portions of the restricted area as necessary to provide the appropriate level of security required to address the specific and credible threat triggering the need for activation.
Availability of the Revised Draft Environmental Impact Statement for the Lower Bois d'Arc Creek Reservoir Project, Fannin County, TX

The U.S. Army Corps of Engineers (USACE) Tulsa District has prepared a Revised Draft Environmental Impact Statement (RDEIS) to analyze the direct, indirect and cumulative effects of the construction of the proposed Lower Bois d'Arc Creek Reservoir (LBCR) and related actions proposed by the North Texas Municipal Water District (NTMWD) in Fannin County, Texas. The Proposed Action is a regional water supply project intended to provide up to 175,000 acre-feet/year (AFY), with an estimated firm yield of 120,665 AFY, of new water for NTMWD's member cities and direct customers in all or portions of nine counties in northern TexasCollin, Dallas, Denton, Fannin, Hopkins, Hunt, Kaufman, Rains and Rockwall. Construction of the reservoir and related facilities would result in permanent impacts to approximately 5,874 acres of wetlands and 651,140 linear feet of streams, and 78 acres of open waters. This action requires authorization from the USACE under Section 404 of the Clean Water Act (CWA). The Section 404 of the CWA permit applicant is the NTMWD. The RDEIS was prepared in accordance with the National Environmental Policy Act (NEPA) of 1969, as amended, and the USACE's regulations for NEPA implementation (33 Code of Federal Regulations [CFR] parts 230 and 325 (with associated Appendices B and C). The USACE, Tulsa District, Regulatory Office is the lead federal agency responsible for the RDEIS and information contained in the EIS will serve as the basis for a decision whether or not to issue a Section 404 of the CWA permit. It also provides information for Federal, State and local agencies having jurisdictional responsibility for affected resources.

The SEIS will supplement the June 1975, Mill Creek Project, Walla Walla, Washington, Final Environmental Impact Statement (FEIS), prepared by the Corps for the operation, maintenance, and improvement of the federally managed portion of the Project. The SEIS will identify and evaluate current O&M actions that may not have been adequately addressed in the 1975 FEIS or have been implemented since completion of the 1975 FEIS, and actions that are proposed for the future. It will also identify and evaluate operational and structural measures the Corps has proposed to improve fish passage through the Project. The 1975 FEIS did not adequately address the effects of the Project on fish species, particularly Mid-Columbia River steelhead and Columbia Basin bull trout. These species were listed under the ESA in the 1990's, and both Mill Creek and Yellowhawk Creek (a distributary of Mill Creek) have been designated as critical habitat.

The Jacksonville District, U.S. Army Corps of Engineers (Corps) is beginning preparation of a supplemental National Environmental Policy Act (NEPA) analysis for the Port Everglades Navigation Improvements Project. The Port Everglades Navigation Improvement Project is designed to address future growth of cargo being transported to southeast Florida on post-Panamax ships due to the completion of the Panama Canal expansion, and to ensure safe navigational conditions for those vessels, as well as vessels currently calling at Port Everglades. The Port Everglades Feasibility Study was authorized through House Document 126, 103rd Congress, 1st Session, and House Document 144, 93rd Congress, 1st Session and by a resolution of the House Committee on Transportation dated May 9, 1996. In response to the study authority, the feasibility study was initiated in 2001 and completed with the signature of a Chief's Report and Record of Decision in 2016. The final recommended project was authorized as part of the Water Infrastructure Improvements for the Nation Act signed December 2016. The non-federal sponsor for the project is Broward County. The primary federal objective is to provide for increased navigational safety, efficiency, and improved economic conditions while limiting impacts to the environment to the maximum extent practicable, in accordance with environmental statutes, applicable executive orders, and other federal planning requirements.

The U.S. Army Corps of Engineers (Corps) is reissuing 50 existing nationwide permits (NWPs), general conditions, and definitions, with some modifications. The Corps is also issuing two new NWPs and one new general condition. The effective date for the new and reissued NWPs is March 19, 2017. These NWPs will expire on March 18, 2022. The NWPs will protect the aquatic environment and the public interest while effectively authorizing activities that have no more than minimal individual and cumulative adverse environmental effects.

Inadequate channel depths result in navigation inefficiencies in transporting goods into and out of the harbor. To reach the terminals, larger ships must lighter outside the breakwaters and/or experience delays while waiting for favorable tide conditions, or both. Deeper and wider navigation features (main channel, maneuvering area, and turning basin) are needed to increase the navigation efficiency and safety of New Haven Harbor.

The U.S. Army Corps of Engineers (Corps) Seattle District has prepared a Draft Environmental Impact Statement (EIS) to analyze the direct, indirect, and cumulative effects of an action proposed by Millennium Bulk TerminalsLongview, LLC (MBTL) involving the Columbia River and adjacent waters of the United States. The Proposed Action is to construct and operate a shipping terminal to export up to 44 million metric tons of coal per year. Construction of the terminal and support facilities would result in the permanent loss of 29.3 acres of waters of the United States, consisting of 24.1 acres of wetlands and 5.2 acres of ditches and other waters. The proposed work requires Department of the Army authorization from the Corps under Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. The permit applicant is Millennium Bulk TerminalsLongview, LLC. This Draft EIS was prepared in accordance with the National Environmental Policy Act (NEPA) of 1969, as amended, and Corps regulations for implementing NEPA (33 Code of Federal Regulations [CFR] Part 230 and Part 325, Appendix B). The Corps' Seattle District, is the lead federal agency, with the Environmental Protection Agency and U.S. Coast Guard participating as cooperating agencies. The U.S. Army Corps of Engineers (USACE), Sacramento District, as the lead agency under the National Environmental Policy Act (NEPA), and the California Department of Water Resources (DWR), as the lead agency under the California Environmental Quality Act (CEQA), will prepare a joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the Lower Elkhorn Setback Levee Project. DWR is the project proponent and may be referred to as the Applicant or Requester. The EIS/EIR will analyze DWR's proposed action to implement a flood risk management project in the Lower Elkhorn Basin in Yolo County, California. Because the proposed action would alter Federal levees, permission from USACE is required under Section 14 of the Rivers and Harbors Act (Section 408) (33 U.S.C. 408). The proposed action would also affect waters of the United States and require a permit from USACE under Section 404 of the Clean Water Act (33 U.S.C. 1344).

Pursuant to the National Environmental Policy Act (NEPA), the U.S. Army Corps of Engineers (Corps), Huntington District prepared a Supplemental Draft Environmental Impact Statement (SDEIS) to disclose potential impacts to the natural, physical, and human environment resulting from modifications to Bluestone Dam. The original EIS was published in 1998 and a Record of Decision (ROD) was signed in 1999 concluding the NEPA process allowing the Corps to initiate implementation of the Bluestone Dam Safety Assurance (DSA) Project. When completed, the current modifications under construction will strengthen the dam's stability and allow for increased discharge capacity through the use of hydropower penstocks substantially reducing risk. However, physical modeling and expert analysis conducted during project construction indicated the downstream bedrock is vulnerable to an unacceptable degree of erosion during high flow events. The Corps has also recognized potential for unacceptable erosion associated with overtopping of areas of the dam not designed to be overtopped. After a full consideration of alternatives to achieve acceptable risk levels, this SDEIS recommends implementing modifications to the existing stilling basin to prevent scour that could result in spillway instability and thus dam failure. Modification may include alteration to the existing stilling basin to include installation of a concrete apron, larger baffles, and would also include non-structural risk management measures. This SDEIS also addresses the prolonged construction duration of modification features described in the original EIS and ROD.

The United States Army Corps of Engineers (Corps) intends to prepare a Supplemental Environmental Impact Statement (SEIS) to address the proposed Springfield Supplemental Water Supply Project (previously referred to as the Proposed Water Supply Reservoir Hunter Lake) in Sangamon County, IL. The Corps, working in conjunction with the City of Springfield, Office of Public Utilities, also known as the City Water, Light & Power (City), prepared an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA) of 1969 [42 U.S.C. 4321 et. seq.] that evaluated a range of alternatives to provide supplemental water supply to meet a projected deficit in water availability. A final EIS was prepared and published in November of 2000. The Final EIS (EIS No. 000402) was published in the Federal Register on November 24, 2000; however, no Record of Decision was issued. The City has conducted an updated water demand analysis that demonstrates a sustained need for additional water supply to meet current and future demands. In accordance with Council on Environmental Quality (CEQ) regulations specified in 40 CFR 1502.9, the Corps in conjunction with the City are initiating the preparation of an EIS supplement.

The U.S. Army Corps of Engineers published a document in the Federal Register on May 24, 2011, amending its regulations to establish a restricted area in the Menominee River at the Marinette Marine Corporation Shipyard in Marinette, Wisconsin. The Corps published correcting amendments in the Federal Register on April 4, 2012, which corrected latitude and longitude coordinates and also revised administrative and enforcement responsibilities. The Corps is proposing to further amend these regulations to expand the existing restricted area to provide additional area of protection during the construction and launching of Littoral Combat Ships. The proposed expansion would result in temporary encroachment within the Menominee River Federal Navigation Channel. The regulations are necessary to provide adequate protection of U.S. Navy combat vessels, their materials, equipment to be installed therein, and crew, while located at the Marinette Marine Corporation Shipyard.

The Jacksonville District, U.S. Army Corps of Engineers (Corps) is beginning preparation of a National Environmental Policy Act assessment for the Western Everglades Restoration Project (WERP). The Everglades ecosystem, including Lake Okeechobee, encompasses a system of diverse wetland landscapes that are hydrologically and ecologically connected across more than 200 miles from north to south and across 18,000 square miles of southern Florida. In 2000, the U.S. Congress authorized the Federal government, in partnership with the State of Florida, to embark upon a multi-decade, multi-billion dollar Comprehensive Everglades Restoration Plan (CERP) to further protect and restore the remaining Everglades ecosystem while providing for other water-related needs of the region. CERP involves modification of the existing network of drainage canals and levees that make up the Central and Southern Florida Flood Control Project. One of the next steps for implementation of CERP is to identify opportunities within the tributary areas of Water Conservation Area (WCA) 3A to restore natural areas within the Big Cypress Seminole Indian Reservation and adjacent portions of Big Cypress National Preserve (BCNP) and the Miccosukee Indian Reservation. Encompassing approximately 440,000 acres located primarily in eastern Hendry County, WCA 3A tributary areas include the C-139, Feeder Canal and L-28 Gap Basins as well as the C-139 Annex and L-28 Interceptor. These areas are collectively called the Western Basins as they are located along the western edge of the Everglades and were historic flow ways. Both water supply and water quality of storm water runoff are challenges facing the Western Basins.

The LOW Project preliminary project area, where placement of features will be considered, covers a large portion of the Lake Okeechobee Watershed north of the lake. Water inflows into Lake Okeechobee greatly exceed outflow capacity, thus many times there is too much water within Lake Okeechobee that needs to be released in order to ensure integrity of the Herbert Hoover Dike. At other times, there may be too little water within Lake Okeechobee. Lake levels that are too high or too low, and inappropriate recession and ascension rates, can adversely affect native vegetation, and fish and wildlife species that depend upon the lake for foraging and reproduction. The volume and frequency of undesirable freshwater releases to the east and west lowers salinity in the estuaries, severely impacting oysters, sea grasses, and fish. Additionally, high nutrient levels adversely affect in-lake water quality, estuary habitat, and habitat throughout the Greater Everglades. The objectives of the LOW Project are to improve the quality, quantity, timing and distribution of water entering Lake Okeechobee, provide for better management of lake water levels, reduce damaging releases to the Caloosahatchee and St. Lucie estuaries downstream of the lake and improve system-wide operational flexibility.

The U.S. Army Corps of Engineers (COE), Wilmington District, Wilmington Regulatory Field Office has received a permit application for Department of the Army authorization, pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act, from Figure Eight Beach Homeowners' Association Inc. (HOA) to install a terminal groin structure along Rich Inlet and to conduct a supplemental beach nourishment on approximately 4,500 linear feet of oceanfront beach and 1,400 linear feet of back barrier shoreline to protect residential homes and infrastructures along the central and northern sections of Figure Eight Island. The terminal groin structure will be placed perpendicular on the northern tip of the island along the shoulder of Rich Inlet; and the proposed source of the material for the nourishment will be dredged from an area within Nixon Channel, a back barrier channel, that has been previously used for past beach nourishment projects. In case the quantity of material from Nixon Channel is not sufficient, material pumped from (3) nearby upland disposal islands will be used to supplement the nourishment needs. The majority of the material will be disposed within the fillet area, or down shore, of the groin. Pending storm events and shoreline changes, proposed maintenance, or periodic nourishment, of the beach is once every five years, or potentially 6 separate events over the 30-year study period. Nixon Channel and the upland disposal islands are the proposed material sources for the periodic maintenance, or renourishment, events.

Newmarket Creek CAP Section 205, City of Hampton, VA, NEPA Scoping Meeting and Public Comment Period

The Newmarket Creek watershed is subject to flooding from both rainfall and tidal events, and there is a history of flood damage within the watershed. If the USACE determines that there is a potential for a significant environmental impact, the USACE will issue a Notice of Intent to prepare an Environmental Impact Statement in the Federal Register.

The Corps is also proposing to issue two new NWPs and one new general condition. The Corps is requesting comment on all aspects of these proposed nationwide permits. The reissuance process starts with this publication of the proposed NWPs in the Federal Register for a 60-day comment period. The purpose of this Federal Register document is to solicit comments on the proposed new and modified NWPs, as well as the NWP general conditions and definitions. Shortly after the publication of this Federal Register document, each Corps district will publish a public notice to solicit comments on its proposed regional conditions for these NWPs.
