This notice announces HUD's sale of certain unsubsidized multifamily mortgage loans, without Federal Housing Administration (FHA) insurance, in a competitive, sealed bid sale (MLS 2011-2). This notice also describes generally the bidding process used for the sale and certain persons who were ineligible to bid. The Bidder's Information Package (BIP) was made available online to qualified bidders on June 29, 2011. Submission of bids for the loans were required on the bid date, which was August 3, 2011. Awards were made no later than August 4, 2011. Closings are expected to take place by August 19, 2011.
Mortgage and Loan Insurance Programs Under the National Housing Act-Debenture Interest Rates

This notice announces changes in the interest rates to be paid on debentures issued with respect to a loan or mortgage insured by the Federal Housing Administration under the provisions of the National Housing Act (the Act). The interest rate for debentures issued under section 221(g)(4) of the Act during the 6-month period beginning July 1, 2011, is 3 percent. The interest rate for debentures issued under any other provision of the Act is the rate in effect on the date that the commitment to insure the loan or mortgage was issued, or the date that the loan or mortgage was endorsed (or initially endorsed if there are two or more endorsements) for insurance, whichever rate is higher. The interest rate for debentures issued under these other provisions with respect to a loan or mortgage committed or endorsed during the 6- month period beginning July 1, 2011, is 4\1/8\ percent. However, as a result of an amendment to section 224 of the Act, if an insurance claim relating to a mortgage insured under sections 203 or 234 of the Act and endorsed for insurance after January 23, 2004, is paid in cash, the debenture interest rate for purposes of calculating a claim shall be the monthly average yield, for the month in which the default on the mortgage occurred, on United States Treasury Securities adjusted to a constant maturity of 10 years.

The proposed data collection and analyses will be used to inform policy in ways that enable Tribes to more effectively use resources to improve housing conditions. UI performed a similar assessment in 1996, prior to the passage of the Native American Housing Assistance and Self- Determination Act (NAHASDA) of 1996 that fundamentally changed the way Federal funding is delivered to Tribal people. Issues surrounding the changes NAHASDA introduced also are a key part of the proposed study.

The Department of Housing and Urban Development (HUD) is conducting an evaluation of four grant programs funded through HUD's Office of University Partnerships (OUP). The four OUP programs are: Historically Black Colleges and Universities (HBCU); Hispanic-Serving Institutions Assisting Communities (HSIAC); Alaskan Native/Native Hawaiian Institutions Assisting Communities (ANNHIAC); and Tribal Colleges and Universities Program (TCUP). These programs were designed to encourage and expand the growing number of partnerships formed between colleges and universities and their communities. Program grants are used to fund community development activities in disadvantaged communities and to encourage minority- serving colleges and universities to contribute their technical expertise, organizational capacity, and resources to local community development efforts. There has been no prior evaluation of the outcomes or impacts of activities funded through OUP grants, which have an average annual value of $25 million. Therefore, this evaluation will be the first to systematically document program outcomes and to explore how factors such as partnership structure or the types of activities completed with grant funds affect outcomes for OUP grants. In addition, the study will help the Office of University Partnerships better understand the challenges that grantees face in implementing grant-funded activities. The results of the evaluation will assist the Department in designing grant programs in the future. This request is for data collection through a web survey and telephone interviews with 67 OUP grant recipients. The web survey instrument and telephone interview protocol are provided in Appendices 5 and 6, respectively. Together, the web survey and telephone interviews will be used to collect in-depth information about the activities funded with OUP grants. The web survey will be used to develop a comprehensive list of activities undertaken by grantees, and to document the partners and additional funding used to support OUP-funded activities. The telephone interviews will focus on two non-trivial activities per grantee (an activity will be considered non-trivial if more than 20 percent of grant funds from a given OUP grant were dedicated to it). The evaluation team will use the telephone interviews to collect more detailed information on the goals, accomplishments, and beneficiaries of the activities, as well as the partnership structures used to implement funded activities.

Under the Residential Lead-Based Paint Hazard Reduction Act of 1992, the Office of Healthy Homes and Lead Hazard Control (OHHLHC) is authorized to develop, demonstrate, and promote measures to correct lead-based paint-related health and safety hazards in the home environment that affect children, particularly of low-income families. In this notice, the Secretary delegates to the Director, OHHLHC, all authority pursuant to the Lead-Based Paint Poisoning Prevention Act, the Residential Lead-Based Paint Hazard Reduction Act of 1992, sections 501 and 502 of the Housing and Urban Development Act of 1970, and authorizing legislation pertaining to healthy homes and lead hazard control contained within annual appropriations acts, for matters pertaining to healthy homes and lead hazard control. This includes oversight and enforcement of the Lead Disclosure Rule as well as oversight of the Lead Safe Housing Rule for all HUD programs and enforcement of the Lead Safe Housing Rule for Multifamily Housing programs, the Single Family Asset Management program, and Public and Indian Housing (PIH) programs. HUD is moving its regulation implementing the governmentwide common rule on drug-free workplace requirements for financial assistance from one title in the Code of Federal Regulations (CFR) to another title. This relocation of the requirements from one CFR title to another responds to directions from the Office of Management and Budget (OMB) to all federal agencies to consolidate into one CFR title all federal regulations on drug-free workplace requirements for financial assistance. These changes constitute an administrative simplification and make no substantive change in HUD policy or procedures for drug-free workplace.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Public Housing Agencies (PHAs) are responsible for contract administration to ensure that the work for project development is done in accordance with State laws and HUD requirements. The forms are prepared by a general contractor constructing a public housing development under the conventional bid method in order to establish the amount due from a PHA for work completed during the current month. The contractor/subcontractor reports provide details, and summaries of payments, change orders, and schedule of materials stored for the development. PHAs that have entered into an Annual Contributions Contract (ACC) with HUD must develop and keep on file the admissions and occupancy policies approved by HUD.

Public Housing: Physical Needs Assessment

This rule proposes to revise HUD's existing regulations governing a physical needs assessment (PNA) undertaken by a public housing agency (PHA). A PNA identifies all of the work that a PHA would need to undertake to bring each of its projects up to the applicable modernization and energy conservation standards. This rule would require PHAs to project the current modernization and life-cycle replacement repair needs of its projects over a 20-year period, rather than a 5-year period, because the 20-year period coincides better with the useful life of individual properties and their building components and systems to ensure the long-term viability of the property. Additionally, this rule proposes to integrate the performance of the PNA with the performance of an energy audit.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Recipients of Indian Housing Block Grant (IHBG) funds provide plans for low-income housing programs in their communities and submit quarterly reports on funds drawn. Recipients may submit information to correct and/or challenge data used in annual housing assistance formula allocations. Additional requirements have been added: Recipients may purchase insurance from a nonprofit insurance entity approved by HUD. These entities must submit annual audit and actuarial reviews to HUD annually.

Federal Housing Administration (FHA) Appraiser Roster: Appraiser Qualifications for Placement on the FHA Appraiser Roster

This proposed rule updates HUD's regulations to conform to the statutory requirement that appraisers must be certified, rather than licensed, by a state appraisal licensing board in order to appear on the FHA Appraiser Roster. This requirement was established by the Housing and Economic Recovery Act of 2008. Although current HUD practice is in compliance with the statutory mandate, the regulations reflect outdated prior policy of permitting state-licensed appraisers to be listed on the FHA Appraiser Roster. In addition, HUD has taken this opportunity to update the FHA Appraiser Roster by replacing the obsolete references to the Credit Alert Interactive Voice Response System with references to its successor, the online-based Credit Alert Verification Reporting System.
