The APAC and ATACs charters were renewed on June 13, 2023, and the committees are in the public interest in connection with the duties of USDA imposed by the Trade Act of 1974, as amended.

In accordance with the Paperwork Reduction Act of 1995, this notice seeks comments on a proposed revision to the currently approved information collection in support of the Export Sales Reporting program. Specifically, FAS requests public comments regarding whether the collection of the proposed contract by contract information, rather than aggregated sales information, will help improve the timeliness and reliability of the data in USDA's Export Sales Reports; the accuracy of the agency's estimate of the burden of the collection of information including validity of the methodology and assumption used; ways to enhance the quality, utility, and clarity of the information collected; and ways to minimize the burden of the collection of information on those who are to report, including through the use of automated, electronic, mechanical, or other technological collection techniques or other forms of information technology.

Dairy Tariff-Rate Quota Import Licensing Program
This interim final rule amends the regulations that provide for the issuance of licenses to import certain dairy articles under tariff-rate quotas (TRQs) as set forth in the Harmonized Tariff Schedule of the United States (HTSUS). The rule suspends for an additional year the historical license reduction provision which would otherwise apply beginning with the 2023 quota year. This change will allow license holders additional time to adjust to challenging market conditions impacting the dairy sector.

In addition, adjustments have been made to the Appendices to reflect changes to United Kingdom (UK) and European Union (EU) country allocations for certain tariff rate quotas (TRQs) and other changes to the Harmonized Tariff Schedule of the United States (HTSUS) made by the U.S. Trade Representative in response to the withdrawal of the UK from the EU and the accession of Croatia to the EU, which will go into effect for the 2022 quota year. Appendices 1 and 2 for the EU-27 for Additional U.S. Note 16 to Chapter 4 have also been adjusted to account for a clerical error in last year's Appendices 1 and 2 published amounts. This correction does not increase the overall quantity allotted to the EU-27 and the UK.

Information on Dairy Import Licenses for the 2021 Tariff-Rate Quota (TRQ) Year-United Kingdom Designation of Importers for Dairy Import Licenses
The U.S. Department of Agriculture (USDA) has determined that, for the 2021 quota year, the United Kingdom (UK) may designate importers to receive import licenses for specified quantities under certain dairy tariff-rate quotas (TRQs) allocated to the EU-27. In accordance with the definitions in Chapter 4 of the U.S. Harmonized Tariff Schedule (HTS), the UK continues to be eligible to export under dairy TRQ allocations to the EU-27. In previous years, the European Commission (EC) designated importers on behalf of the UK and all other eligible European Union (EU) Member States for dairy TRQ amounts reserved for designated licenses. However, the EC has informed the United States that it no longer has the authority to designate importers on behalf of UK exporters for trade transactions that will occur after December 31, 2020. Accordingly, the EU and the UK have each requested that the UK be permitted to designate importers for portions of certain dairy TRQs for the 2021 quota year. The USDA has agreed to the EU's and UK's requests.
