On November 30, 2022, the Department of the Interior, through the Bureau of Land Management (BLM), published in the Federal Register a proposed rule entitled "Waste Prevention, Production Subject to Royalties, and Resource Conservation." This final rule aims to reduce the waste of natural gas from venting, flaring, and leaks during oil and gas production activities on Federal and Indian leases. The final rule also ensures that, when Federal or Indian gas is wasted, the public and Indian mineral owners are compensated for that wasted gas through royalty payments. This final rule will be codified in the Code of Federal Regulations and will replace the BLM's current requirements governing venting and flaring, which are more than four decades old.

The Department of Energy, Office of Legacy Management (DOE-LM) has filed an application with the Bureau of Land Management (BLM) requesting that the Secretary of the Interior exercise authority under Title II of the Uranium Mill Tailings Radiation Control Act of 1978 (UMTRCA) to permanently withdraw and transfer administrative jurisdiction over 70 acres of public lands at the Durita Mill Tailings Site in Colorado to DOE-LM. The public land and interests in the land would be withdrawn from operation of the general land laws, including the United States mining laws, the mineral and geothermal leasing laws, and the mineral materials disposal laws, subject to valid existing rights, and would be transferred to DOE-LM for long term maintenance and monitoring under a Nuclear Regulatory Commission license as part of the Durita Mill Tailings Site. The United States Air Force has requested that the Secretary of the Interior extend the withdrawal established by Public Land Order (PLO) No. 7613 for an additional 20-year term. PLO No. 7613 withdrew 40 acres of public lands from settlement, sale, location, or entry under the general land laws, including the United States mining laws, subject to valid existing rights, for a period of 20 years, to protect a runway safe zone at Nellis Air Force Base located in Las Vegas, Nevada. This notice advises the public of an opportunity to comment on the U.S. Air Force application for extension of the withdrawal and to request a public meeting.

This final rule adjusts the amounts of civil monetary penalties contained in the Bureau of Land Management's (BLM) regulations governing onshore oil and gas operations and coal trespass. This final rule is required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and consistent with applicable Office of Management and Budget (OMB) guidance. The adjustments made by this final rule constitute the 2024 annual inflation adjustments and account for one year of inflation spanning the period from October 2022 through October 2023.

The annual rental for this lease is $115.47 per acre, and the lease would expire on April 22, 2032, with the option of renewal. This project is located southeast of Billings, Montana.
