This notice of proposed rulemaking would update the description of the distinctive paper and distinctive counterfeit deterrents used to guard against counterfeit and fraudulently altered United States (U.S.) Federal Reserve notes in accordance with the U.S. Code. The Department of the Treasury, Bureau of Engraving and Printing (BEP) is amending its distinctive paper and distinctive counterfeit deterrents regulation to remove obsolete language to align the regulation to the current state-of-art and emerging technologies generated as a result of BEP's research and development initiatives; clarify the agency's authority for adopting distinctive paper and distinctive counterfeits deterrents; and announce the adoption of new distinctive paper and counterfeit deterrents by the Secretary of the Treasury.

The U.S. Department of the Treasury (Treasury), Bureau of Engraving and Printing (BEP) announces the availability of the Record of Decision (ROD) for the proposed construction and operation of a Currency Production Facility (CPF) within the National Capital Region (NCR) (Proposed Action). Treasury previously published its Final Environmental Impact Statement (EIS) for the Proposed Action on June 4, 2021. In accordance with the National Environmental Policy Act (NEPA), the ROD identifies all alternatives Treasury considered for the Proposed Action, identifies the environmentally preferable alternative, states Treasury's decision to implement the Preferred Alternative, and discusses factors balanced by the agency in making its decision. The ROD also adopts all practicable mitigation measures to avoid or minimize environmental harm and commits to monitoring their implementation. The Proposed Action will replace Treasury's insufficient Washington, DC production facility (DC Facility), and will provide Treasury with a modern, scalable, sufficiently sized production facility within the NCR that meets Treasury's needs. Treasury has also signed a Finding of No Practicable Alternative (FONPA) addressing potential impacts on wetlands Executive Order 11990, Protection of Wetlands.

The Department of the Treasury (Treasury) and the Bureau of Engraving and Printing (BEP) are issuing this Notice pursuant to the ruling in American Council of the Blind v. Paulson that ordered Treasury to provide meaningful access to U.S. currency to people who are blind and visually impaired pursuant to section 504 of the Rehabilitation Act of 1973, as amended. BEP seeks to develop a solution that fully complies with the Court's order and provides people who are blind and visually impaired meaningful access to U.S. currency, while also giving appropriate consideration to the interests of domestic and international users of currency, U.S. businesses, and cash handling and cash-intensive industries. The purposes of this Federal Register Notice are to inform the public of the features that BEP intends to propose to the Secretary of the Treasury to accommodate people who are blind and visually impaired in denominating U.S. currency, and to solicit public comment on the proposed accommodations.
