Environmental Impact Statement for Cumberland Fossil Plant Coal Combustion Residual Management

The Tennessee Valley Authority (TVA) intends to prepare an Environmental Impact Statement (EIS) to address the potential environmental effects associated with management of coal combustion residual (CCR) material produced at the Cumberland Fossil Plant (CUF) located near Cumberland City, Stewart County, Tennessee. The purpose of the proposed EIS is to address long-term management of CCR produced at CUF. The project will help TVA comply with state and federal regulatory requirements related to CCR production and management, including the requirements of U.S. Environmental Protection Agency (EPA's) CCR Rule and Effluent Limitations Guidelines. TVA will evaluate the potential environmental impacts of construction and operation of a new bottom ash dewatering facility and options for management and disposal of dry CCR produced at CUF. TVA will also evaluate closure of the Bottom Ash and the Main Ash Impoundments. TVA will develop and evaluate various alternatives to these actions, including the No Action Alternative. Public comments are invited concerning both the scope of the review and environmental issues that should be addressed.

The Tennessee Valley Authority (TVA) intends to prepare an environmental impact statement (EIS) to address the potential environmental effects associated with ceasing operations at the special waste landfill and Ash Pond 2 and constructing, operating, and maintaining a new dry coal combustion residual (CCR) landfill at the Shawnee Fossil Plant (SHF) located near Paducah, Kentucky in McCracken County. The purpose of the proposed project is to foster TVA's compliance with present and future regulatory requirements related to CCR production and management, including the requirements of EPA's CCR Rule and Effluent Limitations Guidelines Rule. In the environmental review, TVA will evaluate the potential environmental impacts of closure of the special waste landfill and Ash Pond 2 as well as the construction, operation, and maintenance of an onsite dry CCR landfill or disposal of CCR in an existing offsite permitted landfill. TVA will develop and evaluate various alternatives, including the No Action Alternative, in the EIS. Public comments are invited concerning both the scope of the review and environmental issues that should be addressed.

This final rule amends the regulations of the Tennessee Valley Authority (TVA) for the protection of archaeological resources by providing for the issuance of petty offense citations for violations of the Archaeological Resources Protection Act (ARPA) and the Antiquities Act of 1906 (AA). Amending the regulations such that TVA law enforcement agents are authorized to issue citations will help prevent loss and destruction of archaeological resources resulting from unlawful excavations and pillage.

This notice is provided in accordance with the Council on Environmental Quality's regulations (40 CFR parts 1500 to 1508) and Tennessee Valley Authority's (TVA's) procedures for implementing the National Environmental Policy Act (NEPA). TVA's Final Ash Impoundment Closure Environmental Impact Statement (EIS) Part IProgrammatic NEPA Review analyzed methods for closing impoundments that hold coal combustion residuals (CCRs) on a programmatic basis. Part II of this EIS addressed closing 10 impoundments or other wet-CCR facilities (collectively, ``impoundments'') at six of TVA's plants on a site- specific basis. TVA has decided that the environmental and other factors identified in part I for screening and evaluating closure alternatives on a site- specific basis are appropriate for use in its future decision-making processes involving the proposed closure of CCR impoundments. It also has decided to implement the preferred closure alternatives identified for each of the site-specific evaluations in part II. The Notice of Availability (NOA) of the Final Ash Impoundment Closure EIS, Part I Programmatic NEPA Review and Part II Site Specific NEPA Reviews was published in the Federal Register on June 10, 2016.

The Tennessee Valley Authority (TVA) intends to prepare an environmental impact statement (EIS) addressing the impacts of alternative plans for managing public lands on eight TVA reservoirs in Alabama, Kentucky and Tennessee: Chickamauga, Fort Loudoun, Great Falls, Kentucky, Nickajack, Normandy, Wheeler and Wilson. TVA also proposes to use the information included in these eight reservoir land management plans (RLMP) to revise its Comprehensive Valleywide Land Plan. Public comment is invited concerning the scope of the EIS, including the appropriate uses for TVA-managed public lands on these reservoirs and environmental issues that should be addressed as a part of this EIS.
