Publication of State Plan Pursuant to the Help America Vote Act
Pursuant to sections 254(a)(11)(A) and 255(b) of the Help America Vote Act (HAVA), Public Law 107-252, the U.S. Election Assistance Commission (EAC) hereby causes to be published in the Federal Register changes to the HAVA State plans previously submitted by New Jersey and Wisconsin.
Submission for OMB Review-Evaluation of EAC Educational Products; Comment Request
On September 8, 2009, the EAC published a notice in accordance with Section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995. EAC announced an information collection and sought public comment on the provisions thereof. The EAC, pursuant to 5 CFR 1320.5(a)(iii), intends to submit this proposed information collection (Evaluation of EAC Educational Products) to the Director of the Office of Management and Budget for approval. The Evaluation of EAC Educational Products (Evaluation) asks election officials questions concerning the effectiveness, use, and overall satisfaction with the educational products by State and local election officials. The results of the evaluation will be used internally as a decision-making tool to guide the EAC's determination about future updates and reprints of these work products. Section 202 of HAVA requires EAC to serve as a national clearinghouse and resource for the compilation of information related to the administration of Federal elections. Section 202(3) authorizes EAC to conduct studies and to carry out other duties and activities to promote the effective administration of Federal elections.

Election Administration and Voting Survey Data Policy
The U.S. Election Assistance Commission (EAC) seeks public comment on the Proposed Election Administration and Voting Survey Data policy. The policy provides additional direction to election officials responsible for completing EAC's Election Administration and Voting Survey information about the processes and procedures that will guide their submission, review, and correction of the survey data. The EAC issues the survey to meet its obligations under the Help America Vote Act to serve as national clearinghouse and resource for the compilation of information with respect to the administration of Federal elections; to fulfill its data collection requirements under the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA); and meet its National Voter Registration Act (NVRA) mandate to collect information from states concerning the impact of that statute on the administration of Federal Elections.

The EAC issues the survey to meet its obligations under the Help America Vote Act to serve as national clearinghouse and resource for the compilation of information with respect to the administration of Federal elections; to fulfill its data collection requirements under the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA); and meet its National Voter Registration Act (NVRA) mandate to collect information from states concerning the impact of that statute on the administration of Federal Elections.

Reorganization of National Voter Registration Act Regulations
The Federal Election Commission (FEC) and the Election Assistance Commission (EAC) are jointly taking action to transfer regulations implementing the National Voter Registration Act of 1993 (NVRA) from the FEC to the EAC. The Help America Vote Act of 2002 transferred the FEC's former statutory authority regarding the NVRA regulations to the EAC. Further information is provided in the supplementary information that follows.

Debt Collection
The Debt Collection Act requires federal agencies to either adopt existing regulations or promulgate its own regulations governing the collection of debts owed to the federal government. The U.S. Election Assistance Commission (EAC) is a federal agency, and has decided to implement the regulations jointly issued by the Treasury Department and the Department of Justice entitled Federal Claims Collection Standards by cross referencing these regulations as discussed in this rule.

Proposed Guidance on Voluntary Voting System Guidelines
The Help America Vote Act of 2002 (HAVA) (Pub. L. 107-252; 42 U.S.C. 15301 et seq. (October 29, 2002)) established the U.S. Election Assistance Commission (EAC). Section 202 of HAVA directs the EAC to adopt voluntary voting system guidelines (VVSG) and to provide for the testing, certification, decertification, and recertification of voting system hardware and software. The VVSG provides specifications and standards against which voting systems can be tested to determine if they provide basic functionality, accessibility, and security capabilities.

Notice of Request for Public Comment on Proposed Working Group Policy
The EAC seeks public comment on a proposed policy entitled ``Proposed Working Group Policy.'' This policy is designed to set procedures and requirements for the formation and use of working groups to assist the United States Election Assistance Commission in developing proposed policies, including advisories, guidance, opinions, regulations and rules regarding the implementation of the Help American Vote Act (HAVA) and the National Voter Registration Act of 1993 (NVRA). EAC issues this notice according to a policy adopted on September 18, 2008 that requires EAC to provide notice and an opportunity for public comment on, among other things, advisories being considered for adoption by the U.S. Election Assistance Commission.
Federal Advisory Committee Act; Board of Advisors Charter Renewal
In accordance with the Federal Advisory Committee Act (Pub. L. 92-463), the purpose of this notice is to announce that the U.S. Election Assistance Commission (EAC) has renewed the charter for the Board of Advisors for a two-year period through December 19, 2010. The Board of Advisors is a federal advisory committee under the Federal Advisory Committee Act.

The EAC, as part of its continuing effort to reduce paperwork and respondent burden in accordance with the Paperwork Reduction Act of 1995, invites the general public and other Federal agencies to take this opportunity to comment on proposed information collections; and recordkeeping requirements. Comments are invited on: (a) Whether the proposed collections of information and/or recordkeeping requirements are necessary for the proper performance of the agency's functions, including whether the information has practical utility; (b) the accuracy of the agency's estimate of the burden of the proposed information collections and/or recordkeeping requirements, including the validity of the methodology and assumptions used; (c) ways to enhance the quality, utility, and clarity of the information to be collected or records to be kept; and (d) ways to minimize the burden of the information collections and/or recordkeeping requirements on respondents. Comments submitted in response to this notice will be summarized and/or included in the request for OMB approval.

The EAC seeks public comment on a ``U.S. Election Assistance Commission Draft Strategic Plan Fiscal Years: 2009 Through 2014.'' The EAC developed a strategic plan that lays out an approach to create a receptive and productive agency fully capable of the unique leadership role it has been given as a national clearinghouse, a manager of Federal financial assistance, a certifier of voting systems, and a resource for election officials throughout the country regarding the administration of Federal elections. EAC issues this notice according to a policy adopted on September 18, 2008 that requires EAC to provide notice and an opportunity for public comment on, among other things, advisories being considered for adoption by the U.S. Election Assistance Commission.

The EAC seeks public comment on the proposed policy ``Advisory 09-001 Maintenance of Effort Funding.''
