The Commission scheduled the final phase of the investigations following notification of preliminary determinations by Commerce that imports of emulsion styrene-butadiene rubber from Brazil, Korea, Mexico, and Poland were being sold at LTFV within the meaning of section 733(b) of the Act (19 U.S.C. 1673b(b)). Notice of the scheduling of the final phase of the Commission’s investigations and of a public hearing to be held in connection therewith was given by posting copies of the notice in the Office of the Secretary, U.S. International Trade Commission, Washington, DC, and by publishing the notice in the Federal Register of March 13, 2017 (82 FR 13503). AGENCY: Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on May 10, 2017, under section 337 of the Tariff Act of 1930, as amended, on behalf of Aqua Shield, Inc. of West Babylon, New York. An amended complaint was filed on July 17, 2017. Supplements to the amended complaint were filed on August 10, 2017 and September 5, 2017. The complaint, as amended, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain pool and spa enclosures by reason of infringement of certain claims of U.S. Patent No. 6,637,160 (‘‘the ’160 patent’’). The amended complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute. The complainant requests that the Commission institute an investigation and, after the investigation, issue a limited exclusion order and cease and desist orders. Determination

    On the basis of the record \1\ developed in the subject
