From the Department of Energy
Consumer Refrigerator and

The U.S. Department of
Energy (‘‘DOE’’) is granting a waiver

Panasonic Appliances Refrigeration
Systems Corporation of America
(‘‘PAPRSA’’) to waive the requirements
of the DOE refrigerator and refrigeratorfreezer test procedures for determining
the energy consumption of a specific
combination cooler-refrigerator basic
model, PR5181WBC. Under this
extension, PAPRSA is required to test
and rate this basic model in accordance
with the applicable DOE test procedure,
with the exception that it must calculate
energy consumption using a correction
factor (‘‘K-factor’’) of 0.85.
DATES: This extension of waiver applies

SUPPLEMENTARY INFORMATION: In
accordance with 10 CFR 430.27(g), DOE
gives notice of the issuance of its
extension of waiver as set forth below.
The extension of waiver grants PAPRSA
a waiver from the applicable consumer
refrigerator and refrigerator-freezer test
procedures found in 10 CFR part 430,
subpart B, appendix A for combination
cooler-refrigerator basic model,
PR5181WBC, provided that PAPRSA
tests and rates the basic model using the
alternate test procedure described in
this notice. This extension prohibits
PAPRSA from making representations
concerning the energy efficiency of
these products unless the product has
been tested in a manner consistent with
the provisions and restrictions in the
alternate test procedure set forth in the
extension below, and the
representations fairly disclose those test
results. Distributors, retailers, and
private labelers are held to the same
standard when making representations
regarding the energy efficiency of these
products. 42 U.S.C. 6293(c).
I. Background and Authority
Title III, Part B of the Energy Policy
and Conservation Act of 1975, as
amended (‘‘EPCA’’) (42 U.S.C. 6291–
6309) established the Energy
Conservation Program for Consumer
Products Other Than Automobiles, a
program that includes consumer
refrigerators and refrigerator-freezers.1
Part B includes definitions, test
procedures, labeling provisions, energy
conservation standards, and the
authority to require information and
reports from manufacturers. Further,
Part B authorizes the Secretary of
Energy to prescribe test procedures that
are reasonably designed to produce
results that measure energy efficiency,
energy use, or estimated operating costs,
and that are not unduly burdensome to
conduct. (42 U.S.C. 6293(b)(3)) The test
procedure for refrigerators and
refrigerator-freezers is set forth in 10
CFR part 430, subpart B, appendix A.
The regulations set forth in 10 CFR
430.27 contain provisions that allow a
person to seek a waiver from the test
procedure requirements for a particular
basic model of a type of covered product
when the petitioner’s basic model for
which the petition for waiver was
submitted contains one or more design
characteristics that: (1) Prevent testing
1 For editorial reasons, upon codification in the
U.S. Code, Part B was re-designated Part A.
