The Under Secretary of State for Political Affairs issued a Presidential permit to TransCanada Keystone Pipeline, L.P. (‘‘Keystone’’) on March 23, 2017, authorizing Keystone to construct, connect, operate, and maintain pipeline facilities at the U.S.Canada border in Phillips County, Montana for the importation of crude oil. In accordance with Executive Order 13337 (April 30, 2004) and the January 24, 2017 Presidential Memorandum Regarding Construction of the Keystone XL Pipeline, the Under Secretary determined that issuance of this permit would serve the national interest. The term ‘‘facilities’’ as used in this permit means the relevant portion of the pipeline and any land, structures, installations or equipment appurtenant thereto. The term ‘‘United States facilities’’ as used in this permit means those parts of the facilities located in the United States. The United States facilities consist of a 36-inch diameter pipeline extending from the international border between the United States and Canada at a point near Morgan in Phillips Country, Montana, to the first mainline shut-off valve in the United States located approximately 1.2 miles from the international border. The United States facilities also include certain appurtenant facilities. This permit is subject to the following conditions: Article 1. (1) The United States facilities herein described, and all aspects of their operation, shall be subject to all the conditions, provisions, and requirements of this permit and any amendment thereof. This permit may be terminated or amended at any time at the discretion of the Secretary of State or the Secretary’s delegate or upon proper application therefor.
