The regulations at 20 CFR 655.10(b)(4) require an employer to submit Form ETA–9165 to answer questions about any private wage survey submitted to obtain a prevailing wage determination. Immigration and Nationality Act sections 101(a)(15)(H)(ii)(b) and 214(c) authorize this information collection. See 8 U.S.C. 1011(a)(15)(H)(ii)(b) and 1184(c). This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information, and the public is generally not required to respond to an information collection, unless it is approved by the OMB under the PRA and displays a currently valid OMB Control Number. In addition, notwithstanding any other provisions of law, no person shall generally be subject to penalty for failing to comply with a collection of information that does not display a valid Control Number.
