Next Steps We provide this notice under section 10(a) of the Act and Service regulations for implementing the National Environmental Policy Act of 1969 (40 CFR 1506.6). We will evaluate the permit application, associated documents, and comments we receive to make a final determination regarding whether the application meets the requirements of section 10(a)(1)(B) of the Act. We will also evaluate whether issuance of a section 10(a)(1)(B) ITP would comply with section 7 of the Act by conducting an intra-service consultation. We will use the results of our intra-Service consultation, in combination with the above findings, in our final analysis to determine whether to issue the ITP. If the requirements and issuance criteria are met under section 10(a), we will issue the ITP to the applicant to authorize incidental take of the covered species. We will make a permit decision no sooner than 30 days after the date of this notice.
