17A(b)(3)(F) of the Act 6 requires, among
other things, that the rules of a clearing
agency are designed to promote the
prompt and accurate clearance and
settlement of securities transactions
and, to the extent applicable, derivative
agreements, contracts, and transactions
and, in general, to protect investors and
the public interest.
The Commission finds that the
proposed rule change is consistent with
Section 17A of the Act 7 and the rules
thereunder applicable to ICE Clear
Europe. The proposed rule change will
provide for clearing of the CDX.NA
Contracts, which are similar to the
index CDS Contracts currently cleared
by ICE Clear Europe, in accordance with
existing rules and procedures.
Specifically, the Commission believes
that ICE Clear Europe’s proposal to clear
the CDX.NA Contracts pursuant to its
risk management framework,
operational procedures, end-of-day
pricing policies, settlement procedures
and default management policies (as
modified by the proposed rule change)
is designed to promote the prompt and
accurate clearance and settlement of
securities transactions, derivative
agreements, contracts, and transactions,
and in general, to protect investors and
the public interest, consistent with
Section 17A(b)(3)(F) of the Act.8 The
Commission further believes that the
clearing of CDX.NA Contracts in
accordance with ICE Clear Europe’s
existing CDS risk policies (including
margin and guaranty fund), as modified
by the proposed rule change, is
reasonably designed to meet the
requirements of Rules 17Ad–22(b)(1)–
(3) 9 related to the measurement and
management of credit exposures, margin
requirements, and the maintenance of
sufficient financial resources required
for a registered clearing agency acting as
a central counterparty for security-based
swaps.
Additionally, the Commission
believes that the proposed rule change,
as it relates to various clarifying and
conforming changes with respect to
iTraxx Contracts and single name CDS
Contracts, is designed to promote the
prompt and accurate clearance and
settlement of securities transactions and
in general, to protect investors and the
public interest, consistent with Section
17A(b)(3)(F) of the Act.10
The Commission therefore finds that
the proposed rule change is designed to
promote the prompt and accurate

The meeting will last until
approximately 3:00 p.m. and is open to
the public.
The agenda for the committee meeting
will include a summary of the work of
the Fine Arts Office since its last
meeting on November 14, 2014 and the
announcement of gifts and loans of
furnishings as well as financial
contributions from January 1, 2014
through December 31, 2014.
Public access to the Department of
State is strictly controlled and space is
limited. Members of the public wishing
