Federal Register / Vol. 79, No. 137 / Thursday, July 17, 2014 / Notices
reviewed are relevant to the exercise of
these authorities.
Conclusion
The Bureau will closely monitor the
practices of mini-correspondents,
including former mortgage brokers that
have converted to this form, to ensure
that the protections afforded to
consumers under federal consumer
financial law, including the Bureau’s
implementing regulations, are not being
evaded. In doing so, the Bureau will use
all appropriate tools to assess whether
supervisory, enforcement or other
actions are necessary.
IV. Regulatory Requirements
This Policy Guidance is a non-binding
policy guidance articulating
considerations relevant to the Bureau’s
exercise of its supervisory and
enforcement authority under Regulation
X and RESPA, and Regulation Z and
TILA. It is therefore exempt from the
notice and comment rulemaking
requirements under the Administrative
Procedure Act pursuant to 5 U.S.C.
553(b).
Because no notice of proposed
rulemaking is required, the Regulatory
Flexibility Act does not require an
initial or final regulatory flexibility
analysis. 5 U.S.C. 603(a), 604(a).
The Bureau has determined that this
Policy Guidance does not impose any
new or revise any existing
recordkeeping, reporting, or disclosure
requirements on covered entities or
members of the public that would be
collections of information requiring
OMB approval under the Paperwork
Reduction Act, 44 U.S.C. 3501, et seq.
Dated: July 9, 2014.

Director, Bureau of Consumer Financial
Protection.
